Mr. Ken Barthel Barthel Homes, Inc. 21370 Sesame Street Rogers, Minnesota 55374 Re: Bar-thel's Rum River Acres Second Addition ~ Dear Mr. Barthel: m m m m In response to Mr. Oavid Omann's letter dated August 29, 1983, we agree that the Mn/DOT Standard Specifications allow the percentage of bituminous material-to be within plus or minus 0.3 percentage point of the amount designa:ted by the engineer. This would allow the minimum oil content to be 5.2 percent. Based on five tests taken on the project, only two meet that requirement. In addition, the gradation on bituminous mixture did not meet the specifications for a 2341 Plant Mixed Bituminous Mixture. Mr. Omann, in his letter of August 29, 1983, indicated that the gradation of the mixture met specifications. However, he was comparing the mixture with a 2351 Asphaltic Concrete Surface used for airports. In lieu of seal coating the streets as previously recon~ended to compensate for the inferior bituminous mixture, the City may accept a maintenance bond over a four-year period of time. This would guarantee against breakage and the need for seal coating prior to. the City's five year schedule. An inspection of the streets revealed that-breakage on the east side of Dysprosium Street Northwest in front of Lot 2, Block 6 has occurred. Also, settlement has occurred'on the west side of Dysprosium Street in the vicinity of 162nd Avenue. These deficiencies should be repaired within a resonable time as required by the Article 170.039I of the City Code. If you have any questions in regard to this letter feel free to contact me.
