I <br />I <br />I <br /> <br /> PROPOSED <br />DEVELOPMENT AGREEMENT <br /> <br /> THIS AGREEMENT made and entered into this day of September, 1983, <br />by and between S. J. Groves and Sons Company, hereinafter called "Developer" <br />and the City of Ramsey, hereinafter called "City". <br /> <br /> WHEREAS, the Developer has requested the City to approve a site plan <br />for development of an equipment storage yard on the following described prop- <br />erty: <br /> '!.,~ ,~ <br /> <br /> Lot 1 Block 1 Ramsey 67 Industrial Park 2nd Addition, Anoka County, <br /> Minnesota ~ <br /> <br />and <br /> <br />WHEREAS, said property ~is owned by the Developer; and <br /> <br />WREREAS, the proposed use is an equipment storage yard; and <br /> <br /> WHBREAS, said property is in the City's Industrial Zoning, which zone <br />permits the use pr6posed by the Developer. <br /> <br />NOW THEREFORE, for an in consideration of the mutual agreements and covenants <br />and Conditions hereinafter contained, <br /> <br />IT IS HEREBY AGREED AS FOLLOWS: <br /> <br /> 1) That the Developer may store in the site only that equipment as <br />listed on Exhibit "A" at.tached hereto as Exhibit "A". <br /> <br /> 2) That the Developer may not store any fuels or hazardous wastes on <br />the site. <br /> <br /> 3) That the Develper may not at any time operate the site asa salvage <br />yard for the canabolizing of equipment. <br /> <br /> 4) That the Developer shall maintain the site in a sightly manner at <br />all times and that said maintenance shall include the cutting of the grass and <br />compliance with all City Codes and regulations. <br /> <br /> 5) That the Developer shall provide the' City with a $1,000 bond, irre- <br />vocable letter of credit or cash escrow to insure compliance with all the terms <br />of this agreement, the terms which escrow agreement shall be approved by the <br />City. <br /> <br /> 6) That the terms and conditions of this agreement and the site shall <br />be reviewed annually for compliance by the City Staff and should there be any <br />non compliance, the matter shall be referred to the City for further action.~% <br /> <br /> ; <br /> 7) That the Developer understands and agrees that any violation of <br />this agreement shall render said agreement null and void and the right to <br />use the subject property as an equipment storage yard revoked. That the <br />storage of the items listed ih Exhibit "A" shall be in accordance with the <br />site plan, attached hereto as Exhibit "B". <br /> <br /> <br />
