Motion by and seconded by to adopt <br />Resolution #83- requesting that the Minnesota Department <br />of Transportation approve the plans for the ingress and egress <br />from State Highway #47 to the City of Ramsey's recreation area. <br />(Please refer to resolution file for Resolution #83- .) <br /> <br />Motion carried. Voting yes <br />Voting no <br /> <br />GRANTING OF VARIANCE IN I~EGAI~DS <br /> <br />TO PARAGRAPH 170. 0310C ENTITLED <br /> <br />"RECORDING"OF THE CITY CODE: <br /> <br />During this recession, the City of Ramsey started granting variances <br />to Paragraph 170.0310C of the City Code which pertains to the recording <br />of a plat which accomplished the following for the developer: <br /> <br />a) He did not get committed to a development contract to put <br /> in a street for his development. <br /> <br />b) He did not get committed to an increase in property taxes <br /> on his land because his land is in an unplatted state. <br /> <br />The question is, does the Council want to continue on with granting <br />these variances, as they do become an administrative problem for <br />the City of Ramsey. We currently have the following developments <br />that fall into this category: <br /> <br />a) <br /> <br />Meadowbrook Estates - They were granted final plat approval <br />back in September 1980 and they still haven't entered into <br />a development agreement or recorded the plat. <br /> <br />Reason - The developer does not want to invest his money <br />in street costs or get stuck with a tax increase.when property <br />is not in demand. <br /> <br />b) <br /> <br />Hy-10 Ramsey - They were granted final plat approval back <br />in March 1981 and sinbe that time have been granted a variance <br />from the City Code. They have constructed the streets in <br />this project but haven't filed the plat. <br /> <br />c) <br /> <br />Ramsey Commons - The~ were granted final plat approval on <br />August 24, 1982 and since that time has been granted one <br />variance. The problem here has been in securing clear title <br />to the land. <br /> <br />I will go over this in more detail with Council at the meeting. <br /> <br />Council Action: Your action will be to note that this has been before <br />you. However, all of the above plats will need time extensions which <br />we will discuss at the meeting.' <br /> <br /> <br />
