I
!

access to the Ox Bow area, if the City should desire one. Mr. Cox
commented that he believes in bonding for tax base, not play areas.
Discussion ensued regarding the liabilities involved with volunteer
workers on City property.

I
I
I
I
i

Motion by Councilmember Sorteberg and seconded by Councilmember Reimann
to adopt Resolution #83-83 authorizing the development of Raudio
donated property as park land contingent upon City Staff determining
that the liability aspects are in order. (Please refer to resolution
file for Resolution #83-83).

Motion carried. Voting Yes: Mayor Gamec, Councilmembers Sorteberg,
Reimann, Schlueter and Van Wagner. Voting No: None.

Usin9 Sorteber~ Irri~at.ion System To Water Central Park:

Dennis Donovan stated that it was nice of Mr. Sorteberg to offer
the use of his irrigation system, that it might cause more problems
and would be better for the City to install it's own system, and
the Park's peak need for the system would conflict with Mr. Sorteberg's
peak time of need.

Case #4: Adoption Of Final Resolution Approvin~ Of Industrial Revenue Bond,
Request For; Case Of Prestressed Concrete:

I
I
I

Motion by Councilmember Van Wagner and seconded by Councilmember Reimann
approving of setting a public hearing for approval of industrial revenue
bonds for Prestress Concrete for 7:30 p.m. on June 6, 1983 and further to
take action on the public hearing at that special Council meeting.

Motion carried. Voting Yes: Mayor Gamec, Councilmembers Sorteberg,
Reimann, Schlueter and Van Wagner. Voting No: None.

Council recessed at 10:05 p.m.

Mayor Gamec called the meeting back to order at 10:25 p.m.

Case #5: Reconsideration Of Assessment Policy:
Case #5a: Assessment Ordinance Summary:
Mayor Gamec s~ated ~ha~ as a result ot requests from developers, EDC,
individuals and Councilmembers, the assessment policy has been placed
on the agenda to review the proposed requirements to be placed on developers.

City Attorney Goodrich stated that Council has before them two items for
discussion: #1 - Summary of Assessment Policy Ordinance and Amendment
to Subdivision Code that was adopted on April 26, 1983. This summary is
to be discussed as Case 5a. #2 - Amendment to Ordinance relating to the
Assessment Policy, specifically requirements to be placed on developers.

Regarding requirements to be placed on developers, Council could leave
the the ordinance as is; 25% case deposit plus letter of credit for
balance of project or increase to.a 35% cash deposit and not require
a letter of credit or increase to a 35% cash deposit and require mortgage
on property~or any other combination Council might desire. The argument
against requiring a letter of credit or mortgage is that it ties up the
developers borrowing power.

C/May 31 1983
Page 16 ~f 26
