I I I I SECTION XV: PENALT/~: Every person who shall construct, establish, substantislly 'change, alter or repair any existing structure or use, or permit the gro;.~h of any tree without h .~ complied with the provision of this ordinance or who, having been granted a permit · or variance under the provisions of this Ordinance, shall construct, establish, substantially change or substantially alter or repair any axisting growth or I I I structure or permit the growbh of any tree, excepb as permitted by such permit or variance, shall be guilty of a misdemeanor and sha/1 be punished by a fine' of not more than $5~or impr~, sonment for not more than 90 days or by both. Each day a violation continues t~ exist sh~11 constitute a separate offense. The Airport Zoning Administrator may enforce all provisions of this ordinance through such proceedings for injunctive relief and other relief as may b~ proper under the law~ of Minu. Stat. 360.073 and other applicable law. SECTION XVI: CC~FLICTS: Where there exists a conflict between any of the regulations or limitations prescribed in this Ord~uance and any other regulations applicable to the ssme area, ~ether the conflict' be with respect to bhe height o'f strUctures or trees, the use of laud, or any other matter, the more stringent ~m~tation or regulation shall govern and prevail. SECTION XVII: SEVERABILITY: A. In any ~ase in which the provision of this Ordinance, although generally reasonable, are held by a court to interfere~,ith the use or enjoyment of a particular strUcture or parcel of !and to such an extent, or to be so onerous in their, application to such a structure or parcel of land, as to constitute a taking or deprivation of that property in violation of the constitution of this state or the constitution of the United States, such holding sha]l not affect the application of this Ordinance as. to other structures and parcels of land, and to this end the provisions of this
