Commissioner Bauer introduced the following resolution and moved for its adoption: <br />RESOLUTION #15-02-032 <br />A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE TO THE FRONT <br />YARD SETBACK ON THE PROPERTY LOCATED AT 16877 FELDSPAR STREET NW <br />AND DECLARING TERMS OF SAME. <br />WHEREAS, 21st Century Bank (Permittee), has properly applied for a variance (the <br />"Variance") to the front yard setback from a public street requirement in the R-1 Residential <br />District on the property generally known as 16877 Feldspar Street NW and legally described as <br />follows: <br />Outlot F, Brookfield First Addition, Anoka County, Minnesota <br />Or upon recording <br />Lot 1, Block 1, Brookfield 5th Addition, Anoka County, Minnesota <br />(the "Subject Property") <br />WHEREAS, the Planning Commission conducted a public hearing on February 5, 2015, <br />pursuant to Section 117-53 of the Ramsey City Code, relating to the request for a variance from <br />the front yard setback requirements on the Subject Property. <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF <br />THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows <br />1. That based on Findings of Fact #0940, a Variance to construct a new single family <br />dwelling within the required front yard setback area on the Subject Property is hereby <br />granted. <br />2. That the dwelling on the Subject Property shall maintain a front yard setback of twenty <br />(20) feet from the public road right of way as shown on the attached Exhibit A. <br />3. No construction shall commence until the approved final plat of BROOKFIELD FIFTH <br />ADDITION and an executed Development Agreement regarding said plat have been <br />recorded against the Subject Property and after the issuance of a Building Permit for the <br />dwelling. <br />4. That this Variance shall automatically expire if the use is not initiated by February 5, 2016 <br />and issuance of a Building Permit shall constitute initiation. <br />5. The Permittee shall be responsible for all City costs incurred in administering and <br />enforcing this variance. <br />
