Absent: <br />Commissioners Data and Greenberg. <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />The Commission recessed at 11:03 p.m. <br /> <br />Chairman Heitman called the meeting back to order at 11:16 p.m. <br /> <br />Commissioner Bauerkemper stated that she would like to discuss Chapter 2. <br /> <br />Chairman Heitman stated that he would like to discuss Chapter 8. <br /> <br />Commissioner Gamec stated that Chapter 8 should be handled the same as Chapter <br />7, submit it to City Staff for review. <br /> <br />Discussion ensued regarding Section 8.04.01 and whether or not there can be <br />two majorities when dealing with a petition, counter-petition and counter <br />counter-petition. There is some consensus from Commission that there can <br />be; that persons can have a change of mind and sign another petition. <br /> <br />Comissioner Lichter suggested deleting the 4th, 5th, 6th, 7th line and first <br />word of 8th line on Charter draft page 8-3/2. Commission agreed; one petition <br />required to initiate and one petition to oppose. <br /> <br />I <br />I <br />I <br />I <br />I <br /> <br />Chairman Heitman stated that he would also obtain the correct phraseology <br />regarding Mr. Dorn's recommendation to refer to 35% of ~rontage property <br />owners abutting proposed improvement in Section 8.04.01 and incorporate it. <br /> <br />Comissioner Buchanan referred back to Section 7.10.01 and suggested changing <br />the second sentence to read that no obligations can be entered into until 30 <br />days after the final assessment hearing. <br /> <br />Commissioner Lichter suggested that Section 7.10.01 be put on the Commission <br />punch list; what is State law regarding sale and issuance of bonds? <br /> <br />It was suggested that the phrase 'to the City' be added after the words <br />'than 100% of the estimated cost' in the first sentence of Section 8.04.02. <br /> <br />Motion by Commissioner Lichter to adjourn the regular meeting of the Charter <br />Commission. Commissioner TitterUd seconded the motion. <br /> <br />Motion by Commissioner Buchanan to set the adjournment time at 12:15 a.m. <br />Commissioner Sieber seconded the motion. <br /> <br />Commissioner Bauerkemper dismissed herself at this time (12:01 a.m.). <br /> <br />Comissioner Buchanan stated that people should have the opportunity to <br />stop a project after they know what the costs are going to-be. ~-~- <br /> <br />Discussion ensUed regarding adopting assessments prior to the project and <br />how much cost overrun to allow for. <br /> <br />The regular meeting of the Charter Commission adjourned at 12:15 a,m. <br /> <br />Respectfu_~lly submitted, <br /> <br />Sylvia Frolik <br />Secretary <br />Attachment (I) <br /> <br />CC/October 13, 1983 <br />Page 9 of 9 <br /> <br /> <br />
