City Attorney replied that the City Engineer's feasibility report includes <br />how a project will be paid for and proposed units to be assessed. <br /> <br />Merlin Huht stated that the City has the Hunt family in a bind, either they <br />take Ramsey to Court, which they do not want to do, or they face receiving <br />an assessment for a project that was not even petitioned for and if the <br />City goes to condemnation the Hunt's cannot oppose the assessment until <br />the assessment is actually received. <br /> <br />I <br />I <br />I <br /> <br />Mayor Gamec stated that Council's intention is to proceed with the project <br />either.by condemnation or changing the alignment of the road. If the <br />City goes with realigning'the road an easement from the Hunt's would not <br />be required but it is still possible that the Hunt's would receive assessments. <br /> <br />Wesley Hunt - son to James Hunt - Stated that it seems City Council has <br />accepted advice of City Attorney and Engineer and are proceeding with the <br />project, which is to be paid for by assessments. It should be in order to <br />discuss assessments' at this time. <br /> <br />City Attorney Goodrich replied that State law will not allow that, that there <br />are certain procedures to be followed in order to conduct an assessment <br />public hearing. <br /> <br />City Engineer Raatikka stated that the Way. this project was set up, it <br />was proposed that everybody along 167th would be assessed the same as <br />those people in the Jaspar area and the City would pick up remaining costs. <br />It is Council's decision to proceed with that plan or come up with a different <br />assessment proposal. <br /> <br />Councilmember Schlueter ~nquired as to the criteria used when determining <br />how much a property is benefitted. <br /> <br />City Attorney Goodrich replied that it is determined by a qualified appraisal. <br />He also noted that Council could proceed, through proper procedures, to <br />conduct an assessment public hearing before the project goes in, to discuss <br />assessment of the entire project and not just the Hunt property alone. If <br />it is determined that the Hunt property is not to be assessed, the remaining <br />property owners would pick up those costs. <br /> <br />Merlin Hunt inquired as to why MSA funds couldn't be used to finish this <br />portion of 167th. <br /> <br />Mayor Gamec stated that there is no reason to spend all that extra money <br />on such a short span of road, that the costs would be tripledif this <br />section were constructed the same as 167th between Cty. Rd. #5 and #47. <br />He also stated that MSA funds are to be utilized for more thoroughfare type <br />streets versus residential type streets. <br /> <br />City Engineer Raatikka explained that the City does have a map routing out <br />the MSA street system, which streets are planned for improvement and funds <br />for specific improvements are applied for. <br /> <br />Merlin Hunt stated that land was taken from his father when County Rd. #5 <br />was expanded and again when 167th was expanded and now the City wants to <br />take more land again, and all those improved roads are not needed around <br />a farm. <br /> <br />C/May 31, 1983 <br />Page 11 of 26 <br /> <br /> <br />
