MINNESOTA 55t6Zl-0016
October 6, 1983

WORK COMP FOR CAR POOLS

Recent actions of our state legislature extend your workers' compensa-
tion insurance to cover all employees travelling to and from work by
rideshare .arrangement. Effective June 9, 1983, Minn~"sota'workers' com-
pensation statutes were amended by Senate File 891 to insure all employ-
ees presently covered by workers' compensation for injuries they may
sustain while travelling by shared transportation between home and work
and' vice versa. Designated as Chapter 311, this law defines a "ride-
sharing arrangement" as:

"The transportation of persons, for a fee or otherwise, in a
motor vehicle when the transportation is incidental to another
purpose of the driver. The term includes the forms of shared
transportation known as car pools, commuter van pools and bus
pools, whether or not furnished by an employer. A 'ridesharing
arrangement' does not include transportation of employees by an
employer from one place of employment to another."

The definition further states that two or more people travelling in
prearranged ridesharing arrangement constitute a car pool and that
sharing participants need not work for the same employer.
A~~n~unusual twist in this law gives you, the employer, the option of whe-~
ther to include your employees. If ~ d~-~ot wish to e-~end Y0u~-w-~k
c--6-~p-~n%-~-r-~-6e to employees pa~ticzpatlng in'ride~hari-T~--~rrangeme~
YOu must make tha~election in writing. All ~-~a~ 'is'needed is a brief
~ett~o~ a-~c~g? ',

"I (We), elect to exclude coverage under my (our) workers' compen-
~ sation insurance for employees while participating in rideshar-
~~.~ng arrangements."
/'On the 'basis of such a letter, your workers' compensation policy will be
~dorsed accordingly.

If you have any questions regarding this new law and how it might affect
you, we will be most happy to answer them for you.

Sincerely yours,

I
T.
