Section 5.07 - 1st sentence - Change the word 'measure' to 'ordinance'. This item to be addressed at the public hearing. Typographical error in the last sentence of Section 5.07; delete one of the references to 'against'. Regarding legality, in this case it is talking about a one issue election and it is impossible to have an abstinance because if just one person votes, he is the majority. Comission consensus is that Section 5.07 could use some rephrasing; there seems to be some double negatives. The intent of these last two sentences should be that the default condition is for the referendum to fail. Comission consensus is to carry this item on the punchlist for Attorney Dorn's review and to adopt this section as is for the time being. Chairman Heitman restated what he had been informed by League of Cities regarding ordinances and budgets -- that it is a gray area. Comission consensus is not to define ordinance in the charter based on the fact that those persons who should be capable of defining it cannot. This item is stricken from the punchlist. Comission consensus is that the charter shall create as little as Possible with regard to City positions and offices, and Council will create what is necessary for the City. lq~is item is to be stricken from the punchlist and Mr. Schnelle is to be informed of the Comission's decision. Commissioner Sieber stated that the City's argument against adopting the Long Term Financial Plan by ordinance is that the City would be obligated to follow that plan. Comissioner Sieber stated that he doesn't feel this would be the case; that the ordinance could be amended. Comissioner Sieber stated that he would like the Long Term Financial plan to be adopted by ordinance so that it would be subject to initiative and referendum. Comission consensus is to change the first sentence of of Section 7.05.01 to read as follows: 'The City Council shall have prepared a Long Term Financial Plan of at least five years conmencing in the calendar year 1984.' Comission consensus is to add the following sentence between the first and second sentence of Section 7.05.01: 'This plan shall be revised and extended each year.'
