10. <br /> <br />11. <br /> <br />12. <br /> <br />13. <br /> <br />14. <br /> <br />15. <br /> <br />16. <br /> <br />17. <br /> <br />That the Subject Property is zoned R-1 Single Family Residential and the surrounding <br />parcels are zoned R-1 Single Family. <br /> <br />That the Subject Property is approximately 3.1 acres. <br /> <br />That the Subject Property is surrounded by acreage lots that are similar in size. <br /> <br />That custom cabinet businesses operated within an accessory structure are not a permitted <br />use in the R-1 Single Family Residential District without the issuance of a Home <br />Occupation Permit. <br /> <br />That on December 16, 2003 the City Council adopted a Home Occupation Ordinance <br />allowing residents the ability to apply for a Home Occupation Permit to operate a <br />business within an accessory structure and employ non-resident employees as outlined in <br />the Home Occupation Ordinance. <br /> <br />That the Applicant's property is 3.1 acres in size and therefore eligible to apply for a <br />Home Occupation Permit to operate a business within an accessory structure and employ <br />one non-resident employee. <br /> <br />That the accessory structure is located on the Subject Property, which contains a principal <br />dwelling. <br /> <br />That the Applicant has provided a letter stating he has been operating his cabinet business <br />on the Subject Property for 17 years. <br /> <br />That the business operation is considered illegal non-conforming and therefore the <br />Applicant submitted a Home Occupation Permit application in order to comply with City <br />Code. <br /> <br />That the Applicant resides and is the fee title owner of the location of the proposed home <br />occupation. <br /> <br />That the Applicant receives approximately 2 - 3 material truck deliveries on a monthly <br />basis, does not have customers coming to the property and therefore the use is not <br />creating excessive vehicular traffic to the Subject Property as defined in Subd. 4 Section <br />E of the Home Occupation ordinance. <br /> <br />That the Applicant's business hours are Monday - Friday 8:00am - 4:30pm. <br /> <br />That the proposed use will not adversely impact traffic in the area. <br /> <br />That the proposed use is a compatible use to the residential neighborhood due to density <br />and lot size of the surrounding lots. <br /> <br />That the proposed use will not be unduly dangerous or otherwise detrimental to persons <br />residing or working in the vicinity of the use or to the public welfare. <br /> <br />RESOLUTION//04-02-054 <br /> Page 2 of 3 <br /> <br /> <br />
