Given that background, Stafffeels it is now time to discuss how to resolve the situation. The City <br />has stopped Mr. Bauer from doing any additional work on the property until the next steps are <br />determined. Specifically, the City Council needs to consider several items: <br /> <br /> 1) Access: The City Council should discuss the need of having public access of 160°~ Lane <br /> continued beyond the built road to Mr. Bauer's property. Is it desirable to have it as public <br /> right of way for future connections to the west? Are the property owners willing to have <br /> the City purchase it? Initial commun/cation fi:om the property owners indicate that they are <br /> not <br /> <br /> 2) Trees taken down: If it is decided that the City will not pursue the purchase of the fight-of- <br /> way, how does the City rectify the removal of trees on the Dusbabek's and Kaas's <br /> property? <br /> <br /> 3) Alternative access: I_fit is determined that access does not come fi:om 160th Lane, another <br /> access could be created from the intersection of 161~t Lane and Olivine St.. This access <br /> would need to cross a ridge and require the removal of additional trees. <br /> <br />Mr. Bauer and the Dusbabeks and Kaas's will be present for the work session and would like to <br />share their thoughts with the Council on this matter <br /> <br />Attachments: <br /> <br />a) <br /> <br />c) <br />d) <br />e) <br /> <br />Site Location Map <br />Trappers Ridge Plat <br />Deed showing dedication of easement <br />Correspondence from Mr. Steve Dusbabek <br />Correspondence from Mr. Greg Bauer <br /> <br />Action Statement: <br /> <br />Staff is requesting that the City Council review the situation andprovide Staff <br />with direction on the need for access from 160a~ Lane, finding acceptable <br />remuneration to the affectedproperty owners regarding the trees removed from <br />their property, and alternative accesses to Mr. Batter's property. <br /> <br />CCWS: 3.30.04 <br /> <br /> <br />
