PUBLIC HEARING <br />PROPOSED REVISIONS TO THE MIXED USE - PLANNED UNIT DEVELOPMENT <br />ORDINANCE ESTABLISHED IN CITY CODE: <br /> By: Megan Wald, Associate Planner <br /> <br />Background: <br /> <br />During the rewrite of Chapter 9 in 2003, staff brought forward a Mixed-Use Planned Unit <br />Development (MU-PUD) ordinance that would establish the opportunity for certain parcels to be <br />developed with a mixture of residential and commercial uses. The intent of the ordinance was to <br />allow flexibility in the appropriate amount of commercial and residential development, but in no <br />case shall a property be allowed to maximize development with a single use (i.e. residential or <br />commercial). To support the idea to capitalize on these unique opportunities the first statement of <br />intent statement of the MU-PUD district states that this district "is to provide a range of retail <br />and service commercial, office, and residential uses that are organized and planned in a <br />comprehensive manner." <br /> <br />Observations: <br /> <br />It came to staff's attention during the review of the preliminary plat for Rivenwick 4th addition, <br />that the MU-PUD has to provide a minimum of 70% residential uses. As previously stated it was <br />the intention of the MU-PUD district to capitalize on properties that could~ provide a <br />complimentary mixture of commercial and residential uses. The proposed 70% minimum <br />residential requirement appears to be contradictory to the opening sentence of the MU-PUD <br />intent statement. <br /> <br />Staff is proposing to delete the 70% minimum residential requirement and replace it with the <br />following statement; "to provide for an adequate mixture of commercial and residential uses and <br />in no case shall a development contain 100% of any one use." This would provide adequate <br />flexibility to achieve both residential and commercial development and notify developers that the <br />City will not accept a development plan that includes all residential or all commercial. <br /> <br />Recommendation: <br /> <br />Staff is recommending that the Planning Commission provide a positive recommendation to the <br />City Council to introduce and adopt the MU-PUD ordinance with the suggested language <br />change. <br /> <br />Commission Action: <br /> <br />The Planning Commission recommends that the City Council adopt the MU-PUD ordinance as <br />revised by City Staff. <br /> <br />PC: 4.1.04 <br /> <br />49 <br /> <br /> <br />
