CASE # ~ <br /> <br /> Public Hearing <br /> REQUEST FOR A VARIANCE FROM LOT WIDTH REQUIREMENTS; <br /> CASE OF JERRY BOUTA <br /> By: Megan Wald, Associate Planner <br /> <br />Background: <br /> <br />Jerry Bouta is requesting a variance to the minimum lot width requirement on an existing lot of <br />record in order to sell the parcel to a buyer that desires to construct a home. The subject property is <br />generally located west of Highway #47 and north of 167th Avenue. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br /> <br />Site location <br />Property Survey <br />Proposed Findings of Facts <br />Proposed Variance <br /> <br />Notification: <br /> <br />In accordance with State statute, City Staff attempted to notify all owners of property within 350 <br />feet of the Subject Property of the request for variance. <br /> <br />Observations: <br /> <br />The subject property is approximately 1 acre in size and is an existing lot of record. The property is <br />zoned R-1 Single Family Rural Developing and is' surrounded by properties that are also zoned R-1 <br />Single Family. <br /> <br />City Code allows development on existing lots of record that do not meet the current acreage <br />requirements. However, City Code does not permit, with. out the issuance of 'a variance, the <br />development of a home on a lot that does not meet the minimum lot width requirements. City <br />Code defines lot width as the uniform width measured at the property line abutting the street at <br />the minimum building setback line. The R-1 District states that the minimum lot width is 200- <br />feet. The subject property is located adjacent to Sodium Street and measures 188 feet at the 40- <br />foot building setback line. <br /> <br />The subject parcel was platted in a manor that results in the lot being wider at the point adjacent <br />to the public street and becomes slightly narrower at the rear property line. The parcel measures <br />194.71 feet immediately adjacent to Sodium Street, which is only a 5.29 foot deviation from the <br />200 tbot lot width requirement. Soil borings show there is sufficient room for a septic system and <br />an alternate site. The applicant will need to determine the 100 year flood plain elevatic~n and <br />construct a house with the lowest floor elevation at least 2. feet above the 100 year flood <br /> <br />15 <br /> <br /> <br />
