Board Member introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #04-04- <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE-AND DECLARING <br />TERMS OF SAME <br /> <br /> WHEREAS, Jerry Bouta ("Permittee") properly applied for a Variance from minimum <br />lot width requirements in order for a principal dwelling to be constructed on the property legally <br />described as follows: <br /> <br />Lot 1, Block 3, ldemish and Flores Addition, Anoka County, Minnesota <br /> <br />("Subject Property") <br /> <br /> WHEREAS, the Board of Adjustment met on April 1, 2004, conducted the public <br />hearing and adopted findings of fact. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT <br />OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />Based on Findings of Fact #XXX, a variance from minimum lot width requirements is hereby <br />granted in order to allow the applicant the opportunity to sell to a buyer that desires to <br />construct a principal dwelling on the Subject.Property. <br /> <br />The Subject Property will be 12 feet deficient of the 200-foot lot width requirement <br />established in City Code. <br /> <br />The Subject Property is eligible for a building permit for one dwelling unit and related <br />accessory structures in accordance with City Code. <br /> <br />The Permit-tee shall determine the 100 year Flood Plain Elevation prior to issuance of a <br />Building Permit for the principal structure. The lowest floor elevation for the principal <br />dwelling must be 2 feet above the 100 year Flood Elevation. <br /> <br />This variance shall automatically expire if it is not initiated by April 1, 2005, and application <br />for building permit shall constitute initiation. The Permittee may petition for an extension of <br />time in which to complete the variance. Such extension shall be requested in writing and <br />filed with the City at least 30 days before the expiration of the original variance. <br /> <br />6. The Permittee shall obtain all necessary permits prior to commencing any construction. <br /> <br />The Permittee shall make a reasonable effort to locate the residential structure and any <br />accessory buildings constructed on the Subject Property so as not to interfere with the <br />orderly resubdivision of the Subject Property at some point in the future, and by accepting <br />this Permit acknowledges that not doing so may adversely impact the-ability of the Subject <br />property to be subdivided in the future. <br /> <br />23 <br /> <br /> <br />
