Board Member introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #04-04- <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE TO THE <br />IMPERVIOUS SURFACE RESTRICTIONS IN THE CRITICAL RIVER AND WILD <br />AND SCENIC RIVER OVERLAY DISTRICTS TO FACILITATE AN EXPANSION OF <br />SUPERBOWL AND DECLARING TERMS OF SAME <br /> <br /> WHEREAS, Mike Anderson (the "Perrnittee") has properly applied for a variance from <br />the maximum impervious surface restrictions in the Critical River Overlay District and Wild and <br />Scenic Overlay District on the property legally described as follows: <br /> <br />Lot 1, Block 1, Riverview Bowl, Anoka County, Minnesota <br /> <br />(the "Subject Property"); and <br /> <br /> WHEREAS, the Board of Adjustment met on April 1, 2004, conducted the public <br />hearing and adopted findings of fact relating to the request for a variance from impervious lot <br />coverage restrictions. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF NHNNESOTA, as follows <br /> <br />Based on Findings of Fact #0 , a variance to the maximum impervious surface <br />restrictions in the Critical River and Wild and Scenic River Overlay District is hereby <br />granted, contingent upon certification from the Commissioner of the Department of <br />Natural Resources in accordance with Section 9.21.07 (Critical River Overlay District <br />Development Standards), Subd. 7.c (Notification Procedures and Certification). <br /> <br />The Permittee shall not exceed impervious lot coverage of more than 86% (eighty-six <br />percent) for the Subject Property and as reflected on the Site Plan prepared by Cole Group <br />Architects, dated __ 2004, and the Grading and Erosion Control Plan prepared by <br />Surveying & Engineering Professionals, Inc., dated 2004. <br /> <br />The property owner shall obtain all necessary permits prior to commencing any <br />construction. No building permit for the structures shall be released by the City of <br />Ramsey without certification of the variance by the Department of Natural Resources in <br />accordance with procedures established in Section 9.21.07 (Critical River Overlay <br />District Development Standards) and Section 9.23.06 (Scenic River District Provisions) <br />of the Ramsey City Code. <br /> <br />The property owner shall be responsible for all City costs incurred 'in administering and <br />enfbrcing this variance. -. <br /> <br />37¸ <br /> <br /> <br />
