the City of Ramsey did not print a retraction, Mrs. Gallagher could sue for <br />special and general damages. <br /> <br />Councilmember Reimann polled Council for their opinions. <br /> <br />Councilmember Sorteberg stated that he does not feel a retraction is necessary. <br /> <br />Councilmember Van Wagner stated that she does not feel a retraction is necessary. <br /> <br />Councilmember Schlueter noted that even if a retraction were printed, Mrs. <br />Gallagher could still have the option of suing. <br /> <br />City Attorney Goodrich stated that printing a retraction would definited bring <br />Mrs. Gallagher's name into the matter and that he is not so sure Mrs. Gallagher <br />would want this as it would eliminate all "inferences." <br /> <br />Councilmember Schlueter wondered if Mrs. Gallagher was aware of that fact when <br />she initiated these proceedings. <br /> <br />City Attorney Goodrich replied that Mrs. Gallagher must have thought the whole <br />matter through and that she must be aware of the consequences. He also stated <br />that he informed Mrs. Gallagher's attorney of today's meeting and Mr. Elfelt <br />stated that he would be unable to attend and that he was going to advise <br />Mrs. Gallagher not to attend. <br /> <br />Councilmember Schlueter stated that she would like to see a retraction printed, <br />that she would like to see Councilmember Van Wagner defend herself at this <br />point. Councilmember Schlueter further stated that if Councilmember Van Wagner <br />made a decision to author this type of article, then Councilmember Van Wagner <br />should answer to some of the "inferences" that were made in the article. <br /> <br />Councilmember Reimann stated that he does not feel a retraction is necessary. <br /> <br />Motion by Councilmember Sorteberg and seconded by Councilmember Van Wagner to <br />deny the request of Marilyn Gallagher as contained in Anthony Elfelt's letter <br />of April 6, 1983 requesting a retraction relating to an article printed in <br />the "Ramsey Resident" issue of March 19, 1983 that was written by Council- <br />member Van Wagner. <br /> <br />Motion carried. Voting Yes: Councilmembers Reimann, Van Wagner and Sorteberg. <br />Voting No: Councilmember Schlueter. Absent: Mayor Gamec. <br /> <br />ADJOURNMENT: <br /> <br />Motion by Councilmember Sorteber9 and seconded by Councilmember Van Wagner to <br />adjourn the special Council meeting. <br /> <br />Motion carried. Voting Yes: Councilmembers Reimann, Van Wagner,.Sorteberg, <br />and Schlueter. Voting No: None.
