Motion by Councilmember Van Wagner and seconded by Councilmember Sorteberg <br />to adopt Resolution #83-65 approving of accepting the bid on Street Improvement <br />Project #83-2 (167th Avenue NW west of CSAH #5 to Jaspar Street NW). (Forest <br />Lake Contracting). (Please refer to resolution file for Resolution #83-65). <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Sorteberg, Reimann, <br />Schlueter and Van Wagner. Voting No: None. <br /> <br />Receiving Feasibility Study On Sanitary Sewer Trunk For the Raudio And Holm <br />Properties: <br /> <br />Mr. Goodrich submitted copies of a proposed resolution which would confirm <br />the proposed motion in the agenda to receive feasibility report and call for <br />hearing for Sanitary Sewer Trunk Project (Holm and Raudio'properties). <br />Mr. Goodrich recalled the petition which initiated Council's ordering a <br />feasibility study and that it was received on January 11, 1983. Regarding <br />that petition, it is not specific enough to comply with Chapter 429. Council <br />could treat it as a request and not a petition, whereby Council could order <br />in the improvement project on a 4/5 vote. Council should not proceed on the <br />assumption that this petition is adequate as it does not provide a legal <br />description of the subject property, it does not contain a request for <br />assessment and exactly which public utilities are being petitioned for is <br />not clarified. <br /> <br />Robert Johnson - Attorney for Norm Holm - Under the circumstances, the <br />assessment policy as adopted and the situation described by Mr. Goodrich, <br />on behalf of Norm Holm we are withdrawing our request from City Council at <br />this time. We would have to make an appraisal of letter of credit and how <br />it can be financed. Any further action will be by appropriate petition. <br />We hereby withdraw document dated January 11, 1983, NDH Inc., by Norm Holm. <br /> <br />Art Raudio - Would also like to withdraw request from First Guarantee Corp. <br />and Central Investment Corp. Can speak for First Guarantee Corp. and will <br />have a letter forwarded to City Hall confirming withdrawal of request from <br />Central Investment Corp. <br /> <br />Council can still act on this issue with a 4/5 vote, but that would not be <br />with policy of extending sewer and water by petition only. <br /> <br />Motion by Councilmember Van Wagner and seconded by Councilmember Sorteberg <br />to receive the feasibility report as presented and to not order a public <br />hearing on that feasibility report based on the actions taken tonight by <br />the requesting landowners in that they have now withdrawn their requests. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Sorteberg, Reimann, <br />Schlueter and Van Wagner. Voting No: None. <br /> <br />Case #5: Receiving And Accepting Bids On 2~ Ton Truck And Dump Body, Plow, <br /> Wing And Sander: <br /> <br />Motion by Councilmember Sorteberg and seconded by Councilmember Van Wagner <br />to adopt Resolution #83-66 accepting the bids received for the purchase of <br />a 2½ ton truck for the Street Department.
