City Attorney Goodrich stated that the League of Minnesota Cities recommends <br />that where a city knows there is going to be a serious challenge to the <br />assessments, it might be of benefit to conduct an assessment public hearing <br />prior to construction; that way if the City knows the Courts are not going <br />to allow certain properties to be assessed the City has the option of not <br />ordering the project it. <br /> <br />James Hunt inquired as to how the City arrived at 4 units to be assessed on <br />his property. <br /> <br />City Engineer explained that with the current density requirement of one <br />in 10 acres, Mr. Hunt's property could possibly be subdivided into 4 <br />2½ acre lots and the remainder of the property would be outlot. Mr. <br />Raatikka further stated that the total project cost is estimated at $36,400 <br />and bids came in quite a bit under that figure, the City plans to assess <br />out $15,000 and the City will pick up the remaining $21,000. <br /> <br />City Attorney Goodrich informed Council of the alternatives before them: <br />proceed with condemnation, direct City Engineer to realign road, conduct <br />assessment hearing prior to construction. <br /> <br />Motion by Councilmember Sorteberg and seconded by Councilmember Reimann to <br />adopt Resolution #83-78aDeclaring Cost to be Assessed and Ordering Prepara- <br />tion of Proposed Assessment and Resolution #83-78b Hearing on Proposed <br />Assessment for 167th Avenue N.W. west of County Road #5 (Street Improve- <br />ment Project #83-2) further that any construction be tabled until such <br />time as the assessment hearing has been.held, and that said hearing is <br />to be held on June 28, 1983 at 7:30 P.M. in the Ramsey Municipal Center. <br />(Please refer to resolution file for Resolution #83-78). <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Sorteberg, Reimann <br />Schlueter and Van Wagner. Voting No: None. <br /> <br />COUNCIL OLD BUSINESS <br /> <br />Case #1: <br /> <br />Finance (A. Cash ~low Report For April 1983; B. Revenue And <br />Expenditure Report (G~nerai Fund And Park Fund) For January <br />.Through April 1983: <br /> <br />Council noted reviewing the following: <br /> <br />a. Cash Flow Report for April 1983 <br />b. Revenue and Expenditure Report for January through April 1983. <br /> <br />Councilmember Schlueter inquired as to how much funds remain for animal <br />control. <br /> <br />City Accountant Moen replied that $1500 has been spent to date and $6500 <br />has been appropriated for animal control. <br /> <br />Councilmember Schlueter inquired which funds will be used for the Charter <br />Commission. <br /> <br />City Administrator Schnelle replied that Charter Commission funds will be <br />taken from Commissions and Boards. <br /> <br />C/May 31, 1983 <br />Page 12 of 26 <br /> <br /> <br />
