10 Minutes CASE #1: <br /> <br />DISCUSS REVOCATION OF CONDITIONAL USE PERMIT TO <br /> OPEP, ATE AUTOMOBILE SALES AND REPAIR SERVICE; <br /> CASE OF MR. GERALD ROOT <br />By: Anne Norris, Community Development Director <br /> <br />Background: <br /> <br />The City Council granted a conditional use permit to Mr. Gerald Root to operate <br />an automobile sales and repair service at 14600 Nowthen Blvd. NW. The <br />conditions of this permit included that no salvage or junk yard activities <br />would be conducted from the business, that there would be no outside storage of <br />materials other than automobiles that are for sale, and specific hours of <br />operation for the business. In addition, the City Code requires that all <br />parking areas must be adequately graded and paved with a dust-free surface. <br /> <br />Mr. Root appeared to be violating these conditions, as there were miscellaneous <br />vehicle parts in the yard and equipment and trucks for another operation were <br />being stored on the property. <br /> <br />Enclosed for your information are the following items: <br /> <br />a) Conditional use permit agreement dated May 27, 1986 between Mr. Gerald <br /> Root and the City <br />b) Letter from City Staff to Mr. Root dated June 3, 1986 <br />c) Letter from City Staff to Mr. Root dated July 17, 1986 <br />d) Letter from City Staff to Mr. Root dated August 6, 1986 <br />e) Proposed findings of fact <br /> <br />Observations: <br /> <br />At its September 30, 1986 meeting, the City Council granted Mr. Root 30 days to <br />comply with the conditions of the conditional use permit agreement and City <br />Code. In addition, the City Council directed Staff to draft findings of fact <br />for the revocation of Mr. Root's conditional use permit. <br /> <br />As of October 20, it appeared that Mr. Root had made attempts to comply with <br />the conditions of his permit. There did not appear to be any salvage <br />operations on the property and it appears that all vehicles that are not for <br />sale have been removed from the property.
