CASE #1: <br /> <br />NORTHFORK P.U. D. <br /> <br />A. Approval of Adequacy of Environmental Impact Statement <br /> <br />Background: <br /> <br />On January 28, 1986, the City Council approved a scoping document outlining <br />issues and alternatives to be addressed in the Environmental Impact Statement <br />(EIS) for the Northfork P.U.D. project. The purpose of an EIS is to analyze <br />the potential impacts of a proposed project on concerns such as ground and <br />surface water, land use, wetlands and other protected areas, traffic, noise, <br />and wildlife and archaeological/historical sites. The draft EIs was circulated <br />to other governmental agencies for their review and comment. Any comments <br />received were addressed in the final EIS. The final EIS was then distributed <br />to the same agencies for their final review and comments. Council received the <br />final EIS in its June 24 meeting agenda packet. <br /> <br />The Metropolitan Council and Minnesota Pollution Control Agency (MPCA) <br />submitted comments on the final EIS questioning the adequacy of the EIS. The <br />comments appear to refer more to the City's controls on development rather than <br />the adequacy of the EIS. Staff met with representatives of the MPCA and Met <br />Council to discuss their comments and concerns. The comments centered around <br />concerns regarding the density of the proposed project and its impact on ground <br />and surface water and the City's controls for on-site waste disposal systems. <br />In addition, the Met Council expressed concern regarding the density of the <br />project with the intent of rural areas in the metropolitan area. <br /> <br />Enclosed for your information are the following items: <br /> <br />a) Letter dated June 25, 1986 from the Metropolitan Council <br />b) Letter dated June 27, 1986 from MPCA <br />c) Letter dated July 2, 1986 from Department of Natural Resources <br />d) Resolution #86-m approving the adequacy of the EIS for the Northfork <br /> P.U.D. <br /> <br />Observations: <br /> <br />During discussions with MPCA and Met Council, staff outlined controls and <br />policies the City has regarding the siting and maintenance of on-site waste <br />disposal systems. Staff also explained the City's interpretation of Met <br />Council's density standard for rural areas was based on discussion with Met <br />Council staff. In addition, conditions for suitability of lots with respect to <br />adequate soils for on-site waste disposal systems will be included in the <br />development agreement for all future phases of the Northfork P.U.D. <br /> <br />Recommendation: <br /> <br />Council Action: <br /> <br />Motion to adopt Resolution #86-__ approving the adequacy of the EIS for <br />the Northfork P.U.D. project. <br /> <br /> <br />
