CASE #1: NORTHFORK P.U. D. A. Approval of Adequacy of Environmental Impact Statement Background: On January 28, 1986, the City Council approved a scoping document outlining issues and alternatives to be addressed in the Environmental Impact Statement (EIS) for the Northfork P.U.D. project. The purpose of an EIS is to analyze the potential impacts of a proposed project on concerns such as ground and surface water, land use, wetlands and other protected areas, traffic, noise, and wildlife and archaeological/historical sites. The draft EIs was circulated to other governmental agencies for their review and comment. Any comments received were addressed in the final EIS. The final EIS was then distributed to the same agencies for their final review and comments. Council received the final EIS in its June 24 meeting agenda packet. The Metropolitan Council and Minnesota Pollution Control Agency (MPCA) submitted comments on the final EIS questioning the adequacy of the EIS. The comments appear to refer more to the City's controls on development rather than the adequacy of the EIS. Staff met with representatives of the MPCA and Met Council to discuss their comments and concerns. The comments centered around concerns regarding the density of the proposed project and its impact on ground and surface water and the City's controls for on-site waste disposal systems. In addition, the Met Council expressed concern regarding the density of the project with the intent of rural areas in the metropolitan area. Enclosed for your information are the following items: a) Letter dated June 25, 1986 from the Metropolitan Council b) Letter dated June 27, 1986 from MPCA c) Letter dated July 2, 1986 from Department of Natural Resources d) Resolution #86-m approving the adequacy of the EIS for the Northfork P.U.D. Observations: During discussions with MPCA and Met Council, staff outlined controls and policies the City has regarding the siting and maintenance of on-site waste disposal systems. Staff also explained the City's interpretation of Met Council's density standard for rural areas was based on discussion with Met Council staff. In addition, conditions for suitability of lots with respect to adequate soils for on-site waste disposal systems will be included in the development agreement for all future phases of the Northfork P.U.D. Recommendation: Council Action: Motion to adopt Resolution #86-__ approving the adequacy of the EIS for the Northfork P.U.D. project.
