City Engineer should list those areas of the Charter that are not working <br />in order that the Charter Commission will know which chapters to pay <br />particular attention to in the review process. <br /> <br />The Commission scheduled another meeting for November 21, 1988 at 7:30 for <br />the purpose of reviewing the existing City Charter. <br /> <br />Case #3: Discussion Re_~ardiny Petition To Amend City Charter To Include <br /> A Chapter Entitled "Police Department": <br /> <br />Mr. Hartley stated that the question to amend the City Charter to include a <br />chapter entitled 'Police Department' cannot be included on the November 8 <br />General Election Ballot as the ballot was not prepared in a sufficient <br />amount of time to meet the deadline for inclusion on the Absentee Ballots. <br />Mr. Hartley stated that he is going to recommend to City Council that there <br />be a mail-out election on the proposed Charter amendment. <br /> <br />Commissioner Gamec noted that there would be no need for a mail-out or <br />special election if City Council unanimously adopts the proposed Charter <br />amendment and no petitions are submitted opposing it. <br /> <br />Motion by Commissioner Gamec and seconded by Commissioner Lichter to <br />recommend that City Council unanimously adopt the proposed amendment to the <br />City Charter, with the following modifications, for the inclusion of a <br />chapter entitled "Police Department". <br /> <br />1) <br /> <br />Section 13.01 shall read as follows: 'Department created. A police <br />department for the City shall forthwith be established a permanent and <br />shall consist of a Chief of Police, and such other officers and members <br />as may be provided for by the council.' <br /> <br />2. Sections 13.04 (Duties of Chief) and 13.07 (Rules and Regulations) - <br /> References to 'City Counsel' should be changed to 'City Council'. <br /> <br />Section 13.07 (Rules and Regulations) - The last sentence should read: <br />'Such rules and regulations may cover, besides the conduct of the <br />officers and members, uniforms and equipment to be worn or carried, <br />hours of service, vacation, and all other similar matters necessary or <br />desirable for the efficiency of the department.' <br /> <br />Further Discussion: Chairman Sieber noted that City Council can only take <br />action to amend the charter if it is upon the recommendation of the Charter <br />Commission. If that proposed amendment is modified by the Charter <br />Commission, those modifications must be approved by the petition <br />circulating committee prior to submittal to Council· If the committee does <br />not approve of the modifications, the original version of the proposed <br />amendment must go through the election process. <br /> <br />Motion carried. Voting Yes: Chairman Sieber, Commissioners Greenberg, <br />Graen, Steffen, Hamlet, Gamec and Lichter. Voting No: Commissioner Data. <br />Absent: Commissioner Titterud. <br /> <br />Chairman Sieber stated that if Council does not unanimously adopt the <br />proposed charter amendment, the original version of the amendment must go <br /> <br />Page 2 of 3 <br /> <br /> <br />
