Section 8.05. Assessments For Services. The council may provide by ordinance
that the cost of city services to streets, sidewalks, or other public or
private property may be assessed against property benefited an may be collected
in the same manner as special assessments. Such costs shall not be deemed to
be "special assessments" for the purposes set forth in Section 8.03 of this
chapter.

Further Discussion -

Commissioner Buchanan suggested that the charter contain provisions allowing
citizens the right to petition for a public hearing.

Commission discussed Commissioner Buchanan's suggestion and it was decided
not to write such provisions into the charter; that initiative and referendum
is the ultimate tool for getting council's attention.

Commissioner Data dismissed himself from the meeting at 11:22 p.m.

The Commission proceeded to review Chapter 12 of the proposed charter. The
commission consensus is to adopt Chapter 12 as written.

Chairman Heitman pointed out that at one time, Commissioner Sieber suggested
reviewing Chapter 10 Franchises.

Commissioner Sieber stated that he no longer feels it is necessary to review
Chapter 10, that it was modelled after a city's charter, that city has
franchises and must have written the chapter carefully.

The Commission then reviewed Mr. Tom Moorehouse's letter regarding Chapter 1
of the Charter.

The Commission consensus is that Mr. Moorehouse is not accepting the concept
that, in fact, 'city' means the 'people'; that 'city' and 'people' are
synonomous terms.

Commission consensus is that charter drafting is complete and to set a public
hearing date.

Commission consensus is to distribute copies of the final draft to every city
commissioner, councilmember and staff member.

Commissioner Gamec, speaking as the Mayor, stated that he is considering
requesting Council take a stand on the charter and submitting the charter
to City Attorney Goodrich for his review and comments.

Motion by Commissioner Buchanan to set a charter public hearing date of
February 16, 1984 to be followed by a special meeting of the Charter Commission
and the only agenda item will be New Business.

Commissioner Bauerkemper seconds the motion for discussion.

Further Discussion: Commissioner Gamec stated that Councilmembers may have
a conflict in attending on February 16, 1984, that there is a northwest
megion meeting.

Commissioner Buchanan amends his motion to set a public hearing and special
meeting date of February 15, 1984.

CC/January 26~ 1984
