e) <br /> <br />f) <br /> <br />g) <br /> <br />Commissioner Bauerkemper pointed out that the charter also say that <br />failure to do so does not invalidate the budget. <br /> <br />Commissioner Gamec stated that this requirement ma~not coincide with <br />established publication dates of the City Newsletter. The city may <br />be forced'to publish a monthly newsletter to meet publication requirements <br />set forth in the charter. This could be expensive and create a need to <br />raise levy limits; and because the charter requires the newsletter the <br />council will have automatic authority to raise the levy limit. <br /> <br />Commission consensus is to leave Section 7.06.02 as is; the proposed <br />budget will certainly be in draft form two weeks prior to adoption, <br />which is all the charter requires. <br /> <br />Section 7.07.02 - Commissioner Greenberg stated that Staff feels that <br />department heads should be covered so that they can spend for necessary <br />items if funds run out. <br /> <br />Chairman Heitman stated that the recent rewording in 7.07.01 addresses <br />Staff's concerns with 7.07.02. <br /> <br />Section 7.08 - Commissioner Greenberg stated that City Accountant told <br />him that at the time the budget is adopted, Staff does not know if there <br />is any fund balance left from the previous year; they don't obtain that <br />information until later in the year; when they find it can they spend it? <br /> <br />Commission consensus is that in Section 7.08 , b~th references to <br />'estimated receipts' should be changed to 'estimated funds available' <br /> <br />Section 7.09 - Commissioner Greenberg stated that the City Administrator <br />recommended deleting this section completely. The City Administrator <br />feels the City should be able to borrow from trust funds; why go outside <br />the City to borrow and pay interest? If it is a lengthy loan, the general <br />fund should pay interest to that trust fund it borrowed from. <br /> <br />Commissioner Bauerkemper stated that the Charter Commission and City <br />Accounting differ on the definition of trust funds. The charter allows <br />inter-fund loans except in trust funds because they are there for a <br />reason. <br /> <br />Commissioner Sieber stated that it could lead to trouble if we got a <br />liberal council that borrowed unwifely with no concern for payback; <br />do agree that the city should be able to make loans from within. <br /> <br />Commissioner Data if it were allowed to borrow from a trust fund, it <br />would have to be in a way that would not ~iolate that trust fund purpose; <br />one way is to require payback in such a ~ime framework that when the money <br />is needed, it is there. <br /> <br />Commissioner Sieber agreed with Commissioner Bauerkemper; if that is not <br />what it is intented for, why does the City call it a trust fund? A <br />trust fund is sacred and if the city wants that money, don't put it in <br />the trust fund. Agency funds are fair game if they are done by ordinance. <br /> <br />Motion by Commissioner Bauerkemper to leave section 7.09 as is. <br /> <br />Motion by Commissioner Sieber to amend Commissioner Bauerkemper's motion <br /> <br />CC/December 8, 1983 <br />Page 7 of 8 <br /> <br /> <br />
