Mr. Loed~Ing - Regarding subjecting resolutions to initiative and referendum, <br />we did have a degree of doubt but not enough to not have the flexibility. <br /> <br />Mr. Doty - There are a couple of other cities that also had resolutions subject <br />to initiative and referendum. Don't recall if there are any cases on record <br />where a resolution has been subjected to initiative and referendum. <br /> <br />Mr. McCarty - Even if the process of subjecting resolutions to initiative and <br />referendum had been brought to court and the courts stood by council, it would <br />not negate your right to subject ordinances to initiative and referendum. <br />With regards to protection against council redirecting budgeted monies, go <br />with Mr. Loeding's suggestion of requiring a 4/5 vote of council to redirect <br />funds. <br /> <br />Commissioner Titterud inquired if going charter would affect a city's bond <br />rating. <br /> <br />Mr. McCarty - Not at all. This seems to be a scare tactic of the opposition. <br />I suppose you could write a bad Chapter 8 that could end up affecting the <br />city's bond rating. <br /> <br />Mr. McCarty - Referred to Chapter 2 and recommended verbage be added to prevent <br />double dipping in the public offices. At some point in time you have a <br />councilmember who is mid-term while the mayor's term is up. That council- <br />person could run for mayor, lose and fall back into the council seat. Suggest <br />your charter require that anyone running for office resign from present office <br />held. <br /> <br />Mr. Loeding suggested that Mr. McCarty's suggestion would probably be best <br />included in Chapter 4, Section 4.02, Filing For Office. With regards to <br />adopting budget by ordinance, you are saying that budgets are no,.longer <br />administrative but rather legislative, build in some extra protection if <br />you think it is appropriate, rather than going with ordinance. <br /> <br />Chairman Heitman - I am receiving impressions that the city has little latitude <br />with respect to budgets and am coming to the conclusion that budgets should <br />be left as resolutions. I would like to see the Capital Improvement Budget <br />subject to initiative and referendum. <br /> <br />Mr. McCarty - Guard yourselves against intertwining, mixing, confusing or <br />marrying the long term plan with the operating budget. Citizens can gain <br />control by requiring the long term plan be adopted by ordinance and therefore <br />subject to initiative and referendum. If residents don't want a project, <br />Chapter 8 can provide the protection, they can stop the assessment by <br />referendum. <br /> <br />Commissioner Bauerkemper inquired about projects the public does not want <br />and Council puts them in anyway with outside monies. <br /> <br />Co~issioner Gamec clarified that Commissioner Bauerkemper was referring to <br />a park bond issue that was voted down and Council is now using park fund <br />monies to develop Ramsey's Central Park. <br /> <br />Mr. Loeding stated that the long term plan would serve as an early warning <br />to this kind of situation. <br /> <br />Commissioner Gamec inquired as to how much of Mounds View was developed at <br />the time of their charter adoption. <br /> <br />~/October 20, 1983 <br /> Page 3 of 8 <br /> <br /> <br />
