Mr. M¢Carty replied that personnel cost projection comes in a backhanded way; <br />if you project a park, it falls that you will need someone to take care of the <br />park. <br /> <br />Mr. Loeding stated that a charter does not prohibit adding personnel to the <br />long term plan. <br /> <br />Commissioner Data referred to Chapter 8, Section 8.02, 'shall be carried <br />out exclusively under the provisions of this chapter'; and stated that he <br />is not completely clear on the legallity of implications of these words. <br /> <br />Mr. Doty - Without 'exclusively' there would be a possibility of including <br />State Statute #429. That is where you are separating the city from State <br />statute. A charter is the method by which your citizens have the ability to <br />stop something that is objectionable and withoutit you do not have that <br />ability. <br /> <br />Commissioner Data stated that the feedback the Commission has gotten is that <br />caution must be taken because parts of 429 will preclude charter. <br /> <br />Chairman Heitman stated that the Commission had intended: 'Charter or ordinances <br />of Ramsey shall take precedence.' <br /> <br />Mr. McCarty - Chapter 429 does allow charter to supercede that statute in the <br />way that you will assess benefitted properties; don't know that you even <br />need this wording. <br /> <br />Commissioner Sieber stated that rather than forcing council to create an <br />entire ordinance, the Commission assumed 429 would be used as an overlay to <br />fill in the cracks. <br /> <br />Mr. Loeding stated that the Commission should be concerned about doing this, <br />that it is a bit dangerous and the Commission should review 429 in detail and <br />make sure you are not getting in trouble. <br /> <br />Mr. Doty stated that Mounds View copies Duluth's charter for initiating public <br />improvements under the charter exclusively. Duluth gave responsibility to <br />council to draw up appropriate ordinances to cover all that was required by <br />law. <br /> <br />Chairman Heitman inquired if it would not be better to describe the procedure <br />wanted in the charter? <br /> <br />Mr. Loeding replied that it is poor policy to put all that detail in a charter. <br /> <br />Mr. McCarty pointed out that there is no way an ordinance can circumvent the <br />charter; you have that protection in Chapter 8. <br /> <br />Mounds View recommended that the last sentence of Ramsey's draft charter, <br />Section 8.03~ be deleted. <br /> <br />Mr. McCarty also pointed out that the only reason Mounds View's charter was <br />voted in on the first go around was because of a point-by-point comparison <br />of a statutory city and a charter city. <br /> <br />CC/October 20, 1983 <br /> Page 6 of 8 <br /> <br /> <br />
