C/September 10, 1984 <br />Councilmember Reimann - Opposed <br />Councilmember Schlueter - Opposed <br /> <br />Motion by Councilmember Van Wagner and seconded by Councilmember <br />Reimann to adopt Findings of Fact regarding Waste Management of <br />Minnesota, Inc. 's request for a conditional use permit, as <br />presented by Planning and Zoning with the following amendments: <br /> <br />1. Noise Control - Berm proposed will not sufficiently reduce <br /> noise problems. <br /> <br />2. Odor Control - Attempts have been made to control odor <br /> problems at Landfill and nothing to this point, has seemed to <br /> have worked effectively. <br /> <br />3. Detrimental effect on property values in the near vicinity of <br /> the Landfill. <br /> <br />4. Water Pollution - Uncertainties of the Landfill's affect on <br /> the underlying aquifers and potential hazards for water <br /> pollution. <br /> <br />5. Soil Conditions - Sandy soils in that area. <br /> <br />Further Discussion: Mayor Gamec stated that it should also be <br />added to the Findings of Fact that expansion to the south would <br />directly affect the homes of Cowman, Coons and Edwards. Mayor <br />Gamec also requested that Staff follow up to make sure any <br />changes to the Closure or Post Closure are mentioned. <br /> <br />Motion carried. Voting Yes.~ Mayor Gamec, Councimembers <br />Reimann, Sorteberg, Schlueter and Van Wagner. Voting No: None. <br /> <br />Motion by Co'uncilmember Van Wagner and seconded by Councilmember <br />Schlueter to deny the request for a conditional use permit from <br />Waste Management of Minnesota, Inc. based on the Findings of <br />Fact. <br /> <br />Motion carried. Voting Yes: Mayhor Gamec, Councilmembers <br />Reimann, Sorteberg, Schlueter and Van Wagner. Voting No: None. <br /> <br />Motion by Mayor Gamec and seconded by Councilmember Sorteberg to <br />amend the contract between Ramsey and Waste Management of <br />Minnesota, Inc. as follows: <br /> <br />Item 6.b on Page 2 - Delete from contract. <br /> <br />Final Paragraph on Page 2- Delete first sentence. <br /> <br />Further Discussion: Mayor Gamec stated that the conditional use <br />permit has been denied and inquired if it does mean that any <br />expansion of the landfill is eliminated as far as Ramsey is <br />concerned. Mr. LeFevere replied that there is a legal issue as <br />to whether Anoka has the right to continue to expand onto the <br />south 40 given it's first status as a nonconforming use on a <br />current site; that is a question that this action does not bear <br /> <br />Page 8 of 14 <br /> <br /> <br />
