Commissioner introduced the following resolution and moved for its adoption: <br />RESOLUTION #15-04-078 <br />RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE TO THE SIDE YARD <br />SETBACK FOR AN ACCESSORY STRUCTURE ADDITION. <br />WHEREAS, Jeff Rieck (Permittee) has properly applied for a variance to Section 117- <br />111 (R-1 Residential District) of the Ramsey City Code with regard to the minimum setback <br />required for accessory buildings on the property generally known as 6520 170th Ave NW and <br />legally described as follows: <br />Lot 1, Block 6, Shady Lawn Estates, Anoka County, Minnesota <br />(Subject Property). <br />AND WHEREAS, the Planning Commission conducted a public hearing on April 9, 2015, <br />pursuant to Section 117-53 of the Ramsey City Code, and adopted findings of fact relating to the <br />request for a variance. <br />NOW THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That based on Findings of Fact #0944, a variance (the "Variance") to side yard setbacks for <br />accessory buildings, as shown on the attached exhibit, is hereby granted. <br />2. That the addition shall be located no closer than five (5) feet from the eastern side property <br />boundary of the Subject Property. <br />3. That the exterior finish of the addition shall be the same as that of the principal building. <br />4. That the proposed garage addition shall comply with all other applicable Zoning, Building, and <br />Fire Code standards. <br />5. The Permittee shall be responsible for all costs incurred in administering and enforcing this <br />Variance. <br />6. That this Variance shall automatically expire if the use is not initiated by April 9, 2016, and <br />issuance of the building permit shall constitute initiation. <br />The motion for the adoption of the foregoing resolution was duly seconded by Commissioner <br />, and upon vote being taken thereon, the following voted in favor thereof: <br />and the following voted against the same: <br />and the following abstained: <br />
