Councilmember introduced the following resolution and moved for its adoption: <br />RESOLUTION #15-02-048 <br />RESOLUTION GRANTING APPROVAL OF REVISED <br />DEVELOMENT AGREEMENT FOR BROOKFIELD FIFTH ADDITION <br />WHEREAS, 21St Century Bank, hereinafter referred to as "Developer", properly applied <br />to the City of Ramsey (the "City") for a final plat of the following described property located in <br />the City of Ramsey: <br />Outlot F, Brookfield First Addition, Anoka County, Minnesota <br />(the "Subject Property") <br />WHEREAS, on July 7, 2014 the City of Ramsey received applications for Sketch Plan <br />and Preliminary Plat review for BROOKFIELD FIFTH ADDITION from the Developer; and <br />WHEREAS, on August 7, 2014, the Planning Commission conducted a Public Hearing on <br />the Sketch Plan and Preliminary Plat for BROOKFIELD FIFTH ADDITION and continued the <br />Public Hearing to the September Planning Commission meeting to provide the Developer with <br />additional time to address concerns related to the preliminary plat; <br />WHEREAS, on August 27, 2014, the Developer requested the Public Hearing be <br />postponed to provide them with additional time to work with adjacent residents and City Staff; and <br />WHEREAS, on December 8, 2014, the Developer resubmitted applications for Sketch <br />Plan, Preliminary Plat and Final Plat for BROOKFIELD FIFTH ADDITION; and <br />WHEREAS, on January 8, 2015, the Planning Commission conducted a Public Hearing <br />on the request and recommended City Council approve the Preliminary Plat contingent upon <br />compliance with the Staff Review Letter dated January 2, 2015. <br />WHEREAS, on January 27, 2015, the City Council approved the Preliminary Plat and <br />Final Plat with contingencies and approved a Development Agreement subject to review and <br />approval by the City Attorney as to legal form. <br />WHEREAS, on February 17, 2015, the Developer requested that the Development <br />Agreement be assigned to MarQuest Homes LLC, who is purchasing the Subject Property and will <br />be constructing a single family home on the Subject Property. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1) That the Ramsey City Council hereby approves the revised Development Agreement for <br />Brookfield 5th Addition. <br />
