CC Regular Session <br />Meeting Date: 02/24/2015 <br />Submitted For: Len Linton, Engineering/Public Works <br />By: Len Linton, Engineering/Public Works <br />4. 12. <br />Information <br />Title <br />Adopt Resolution #15-02-052 Authorizing Acquisition of a Permanent Easement Necessary for Construction of a <br />Watermain Loop <br />Purpose/Background: <br />The City identified the need for a watermain extension along Garnett Street between 148th Lane and Alpine Park in <br />2008. The alignment crossed property owned by the Minnesota Pollution Control Agency (MPCA). The City <br />negotiated for and received assurances that the MPCA would grant the required easements. The City prepared plans <br />and specifications and received bids for the project. The City contacted the MPCA to coordinate construction and <br />was informed that the necessary easements would not be granted. The City rejected the bids and then began more <br />negotiations with the MPCA to secure the necessary easements. The MPCA agreed to granting the easements in <br />2009. The project was advertised, bid, awarded and the watermain and trail were constructed. Resolutions <br />08-05-092 and 09-04-079 were approved by City Council in support of acquiring the required easements. <br />The MPCA conducted a review of their easements in this area in 2014 and determined that the trail easement and <br />utility easement had not been recorded at Anoka County. <br />City staff review of Resolution 08-05-092 noted that it authorized acquisition of fee title to certain property and <br />permanent easements necessary for the construction of a watermain loop and trail connection. The attachment <br />described easements over platted properties. While preparing the easement for recording it was discovered that the <br />easement crosses un -platted property. This new resolution includes the un -platted property. <br />Notification: <br />Notification of adjacent land owners is not required. <br />Observations/Alternatives: <br />The watermain was installed in 2009 based on the agreement with the MPCA to obtain the necessary easement. <br />The alternative to obtaining the easement would be removal of the watermain across the MPCA property. <br />Funding Source: <br />The MPCA has not requested reimbursement for acquisition of the utility easement. <br />Recommendation: <br />Staff recommends approving Resolution #15-02-052 Authorizing Acquisition of a Permanent Easement Necessary <br />for Construction of a Watermain Loop. <br />Action: <br />Motion to adopt Resolution #15-02-052 Authorizing Acquisition of a Permanent Easement Necessary for <br />Construction of a Watermain Loop. <br />
