<br />10. That the Applicant has stated that there are no existing buildings or structures in the one (1) mile search area of a <br />sufficient height to accommodate the proposed equipment and provide a strong, seamless signal, due to the height of <br />the landfill mound and the signal area necessary for the Applicant to provide coverage over their entire service area <br />with a single tower. <br /> <br />11. That City Code requires newly constructed towers to accommodate at least two (2) additional users. <br /> <br />12. That the proposed use will not negatively affect traffic into and from the premises, or to any adjoining road. <br /> <br />13. That the proposed use will not be unduly dangerous or otherwise detrimental to persons residing or working in the <br />vicinity of the use, or to the public welfare. <br /> <br />14. That the proposed use will not substantially impair the use or market value of surrounding properties. <br /> <br />15. That the proposed use will be harmonious with and in accordance with the specific objectives of the comprehensive <br />plan. <br /> <br />16. That the proposed use will be designed, constructed, operated, and maintained so as to be harmonious and <br />appropriate in appearance with the existing or intended character of the general vicinity and whether such a use will <br />not change the essential character of that area. <br /> <br />17. That the proposed use will not be hazardous or disturbing to existing or future neighboring uses. <br /> <br />18. That the proposed use will be served adequately by essential public facilities and services. <br /> <br />19. That the proposed use will not create excessive additional requirements at public cost for public facilities and <br />services and will not be detrimental to the economic welfare of the community. <br /> <br />20. That the proposed use will not involve equipment and conditions of operation that will be detrimental to any <br />persons, property, or the general welfare by reason of excessive production of traffic, noise, smoke, fumes, glare, or <br />odors. <br /> <br />21. That the proposed use will be consistent with the intent and purposes of Chapter 117. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember Williams, and upon vote <br />being taken thereon, the following voted in favor thereof: <br /> <br /> Mayor Strommen <br /> Councilmember Riley <br /> Councilmember Williams <br /> Councilmember Johns <br /> Councilmember Kuzma <br /> Councilmember LeTourneau <br /> Councilmember Shyrock <br />and the following voted against the same: <br /> <br /> None <br /> <br />and the following abstained: <br /> <br /> None <br />RESOLUTION #15-04-099 <br />Page 2 of 3 <br /> <br />
