Commissioner introduced the following resolution and moved for its adoption: <br /> <br />PROPOSED RESOLUTION g93-05- <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT # RELATING TO A <br />REQUEST FOR A VARIANCE TO CONSTRUCT AN AU'C~SSORY STRUCTURE <br />NEARER THE FRONT PROPERTY LINE THAN THE PRINCIPAL STRUCTURE <br />ON THE PROPERTY GENERALLY KNOWN 7230 153RD LANE N.W. <br /> <br /> WHEREAS, Charles and Jan Hart, hereinafter referred to as "Applicants", have properly <br />applied for a Board of Adjustment variance from Section 9.11.02 of the Ramsey CiD' Code to <br />construct an accessory garage nearer the front property line than the principal structure on the <br />property generally known as 7230 153rd Lane N.W. and legally described as follows: <br /> <br />The West 225 feet of the East 650 feet of the Southeast Quarter of the Northeast Quarter of <br />Section 21, Township 32, Range 25, Anoka County, Minnesota (except the North 1030 <br />feet thereof, said distance being measured parallel with the north and east lines of smd <br />Southeast Quarter of the Northeast Quarter, (subject to and together with an easement over <br />the south 66 feet of the North 1063 feet of the East 650 feet of the Southeast Quarter of <br />Northeast Quarter of Section 21, Township 32, Range 25, said distance being measured <br />parallel with the East and West lines of said Southeast Quarter o£ Northeast Quarter. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF <br />ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF <br />MINNESOTA, as follows: <br /> <br />That the Applicant appeared before the Board of Adjustment for a public hearing pursuant <br />to Section 9.03.05 of the Ramsey City Code on May 27, 1993 and that said public hearing <br />was properly advertised and that the minutes of said public hearing are hereby incorporated <br />as a part of these f'mdings by reference. <br /> <br />That the subject property is zoned R-I Rural Residential and is approximately 1.5 acres in <br />size. <br /> <br />3. That the subject property is surrounded by R-1 Rural Residential zoning. <br /> <br />That Section 9.11.02 of the Ramsey City Code does not permit the construction of <br />accessory structures nearer the front property line than the principal structure. <br /> <br />That the principal smacture on the subject property is located approximately 84 feet from the <br />front property tine. <br /> <br />That the Applicant is proposing to construct a 32' x 32' accessory garage approxLmately 64 <br />feet from the front property line. <br /> <br />That the proposed size of the accessory su'ucture is in compliance with Section 9.11.02 of <br />the Ramsey City Code. <br /> <br />That there are unique cLrcumstances applying to the subject property that do not generally <br />apply to other properties in the district; namely, that the developer of the lot has created a 84 <br />foot front yard setbacl~ by the placement of the home; and to maintain an 84 foot setback for <br />the accessory garage Would require removal of a substantial number of mature trees and the <br />excavation of a substantial amount of fill from the rear yard wkich has a sharp rise in <br />topography. ~k <br /> <br /> <br />
