CASE <br /> <br />REQUEST <br /> <br />Background: <br /> <br /> FOR A VARIANCE TO ENCROACH ON THE THOROUGHFARE <br />SETBACK; CASE OF MICHAEL AND KAREN SEGAR <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Michael and Karen Segar reside at 4911 179th Lane N.W. (C.S.A.H. #27). The home and <br />attached garage were constructed in 1967, prior to the establishment of the 110 foot thoroughfare <br />setback requirement, at a location that is approximately 98 feet from the centerline of <br />C.S.A.H.#27. Therefore, the existing structure is considered lawful nonconforming. <br /> <br />Michael and Karen are proposing to consu-uct a 14' x 23' addition to their existing attached garage. <br />This is considered expanding a nonconforming use, which must be in accordance with City Code, <br />and in this case requires a variance. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br /> <br />Site location map <br />Site plan and written comments submitted by applicant <br />Proposed findings of fact <br />Proposed variance <br /> <br />Observations: <br /> <br />The applicants have stated that to offset the addition to the garage by 12 feet in order to meet the <br />thoroughfare setback will require removal of mature trees and adversely impact the architectural <br />lines of the home. To build a detached garage in the rear yard will require removal of mature ~'ees <br />and relocating the septic system. <br /> <br />The total area of the existing garage and the proposed addition are well within City Code limits for <br />a .6 acre parcel. The construction materials are also in compliance with City Code. <br /> <br />The City has granted similar variances in the past. <br /> <br />Recommendation: <br /> <br />City Staff recommends approval of the variance. <br /> <br />Board Action: <br /> <br />Motion to: <br />Adopt Resolution g93-06- adopting Findings of Fact # relating to Michael and <br />Karen Segags request for a variance to thoroughfare setback requirements at 4911 179th <br />Lane N.W.. <br /> <br />Motion to: <br />Adopt Resolution g93-06- approving the issuance of a variance to Michael and Karen <br />Segar at 491I 179th Lane N.W. and declaring terms of same. <br /> <br />Review Checklist: <br /> <br />Zoning Administrator <br />Building Official <br /> <br />Bd of Adj: <br /> <br />6/24/93 <br /> <br /> <br />
