Board Member introduced the following resolution and moved for its adoption: <br /> <br />A <br /> <br /> RESOLUTION .~93-08- <br />RESOLUTION APPROVING THE ISSUANCE----OF A VARIANCE AND <br /> DECLARING TERMS OF SAME <br /> <br /> WHEREAS, Lynn Mortenson and Marshall Williams have properly applied for a variance <br />fi:om minimum strut frontage requirements in order to construct a dwelling on the property legally <br />described as follows: <br /> <br />That part of the Southwest Quarter of the Northeast Quarter of Section 14, Township 32, <br />Range 25,Anoka County, Minnesota lying southwesterly of the centerline of T.H. 4/47, <br />except road; subject to easement of record. <br /> <br />("Subject Property") <br /> <br /> WHEREAS, the Board of Adjustment met on August 19, 1993, conducted the public <br />hearing and adopted findings of fact. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF <br />ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF <br />MINNESOTA, as follows: <br /> <br />Based on Findings of Fact # , a variance from minimum street frontage requirements to <br />construct a dwelling on the Subject Property is hereby granted. <br /> <br />o <br /> <br />Only one building permit will be issued for a residential structure on the subject property <br />and no further building permits for residential structures will be issued until such time as <br />the Subject Property is replatted and developed to a higher density in accordance with City <br />Code. <br /> <br />Only one private driveway will be granted access to 160th Lane N.W. by an easement fi:om <br />the City across the dedicated, unimproved right-of-way for Osmium Street N.W. Although <br />Osmium Street N.W. is public right-of-way, the maintenance of the private driveway <br />across this public right-of-way will be the responsibility of the homeowner by the nature of <br />its use. <br /> <br />Any further subdivision of the Subject Property south of the county ditch shall require the <br />developer to extend Osmium Street N.W. north into the Subject Property and required <br />improvements will include paving Osmium Street N.W. south to 160th Lane N.W. <br /> <br />At such time as the subject property is replatted to a higher density, the residential structure <br />located on the Subject Property will be provided access to a public road, at the expense of <br />the property owner, within said plat and the easement across the public road right-of-way <br />for Osmium S~eet N.W. will no longer be valid. In the interim, the property owner agrees <br />to join in an initial petition calling for a feasibility study for improvements to Osmium Street <br />N.W. when and if such a petition is presented. <br /> <br />o <br /> <br />Until such time as the Subject Property is served by interior streets, the property owner <br />agrees to participate in any street maintenance projects assessed to Hall Anderson Acres. <br /> <br />7 <br /> <br /> <br />
