Commissioner <br /> <br />mu-oduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #93-10- <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT # RELATING TO GARY <br />MILLER'S REQUEST FOR A VARIANCE TO CONS"i"-~UCT AN ACCESSORY <br />STRUCTURE NEARER THE FRONT PROPERTY LINE THAN THE PRINCIPAL <br />STRUCTURE ON LOT 4, BOWERS MISSISSIPPI ACRES <br /> <br />That Mr. Gary D. Miller, hereinafter referred to as "Applicant", has properly applied for a <br />Board of Adjustment variance from Section 9.11.02 of the Ramsey City Code to consumct <br />an accessory structure nearer the front property line than the principal structure on the <br />property generally known as 14810 Bowers Drive N.W. and legally described as follows: <br /> <br />Lot 4, Bowers Mississippi Acres, Anoka County, Minnesota <br /> <br />That the Applicant appeared before the Board of Adjustment for a public hearing pursuant <br />to Section 9.03.05 of the Ramsey City Code on October 21, 1993, and that said public <br />hearing was properly advertised and that the minutes of' said public hearing are hereby <br />incorporated as a pan of these findings by reference. <br /> <br />That the subject property is zoned R-1 Rural Residential and is approximately. . acre in <br />size. <br /> <br />4. That the subject property is surrounded by R-I Rural Residential zoning. <br /> <br />o <br /> <br />That Section 9.11.02 of the Ramsey City Code does not permit the construction of <br />accessory structures nearer the front property line than the principal structure. <br /> <br />That Chapter 9.21 of the Ramsey City Code establishes a structure setback of 200 feet from <br />the Mississippi River. <br /> <br />° <br /> <br />That the principal structure on the property is located approximately 248 feet from the front <br />property line and 135 feet from the Mississippi River. <br /> <br />That the Applicant is proposing to construct a 26' x 30' accessory structure on the property <br />that will be approximately 152 feet from the front property line. <br /> <br />That a lack of sufficient space and the location of the on-site septic system prohibit siting <br />the new accessory structure in the side yards. <br /> <br />10. <br /> <br />That if the accessory structure were to be constructed in the rear yard, it would encroach on <br />the 200 foot setback from the Mississippi River. <br /> <br />11. <br /> <br />That similar variances have been granted in the R-1 Rm'al Residential District generally and <br />in various additions of Bowers Mississippi Acres specifically. <br /> <br />12. <br /> <br />13. <br /> <br />That the total amount of existing and proposed accessory space does not exceed the limits <br />established by City Code. <br /> <br />That if granted, the proposed variance will/will not impair an adequate supply of light and <br />air to adjacent property. <br /> <br /> <br />
