CASE # .3 <br /> <br />REPORT REGARDING SEWER AVAILABILITY CHARGE REVIEW ON 6740 <br />HIGHWAY 10, BILL DUBATS PROPERTY <br /> By: Jessie L. Hart, Finance Officer and Glyn Huff, Building Official <br /> <br />BACKGROUND: <br /> <br />The property located at 6740 Highway 10 is owned by Bill Dubats (Lakeview Development <br />Company) and is utilized as office space. Mr. Dubats changed the use of the property, from a <br />daycare with 64 children to an office complex, which necessitated filing a SAC adjustment form <br />with the Metropolitan Waste Control Commission (MWCC). Glyn Huff, Building Official <br />completed this form (see attached) based on a review of the premise. The original determination <br />was approved by the MWCC in October of 1988 at 5 SAC units. It is believed that the SAC <br />charges paid at that time were approximately $2,750 for the five units. Based on the change in <br />use, the new SAC units would be 2 units. While this is what Glyn calculated, it is not final until <br />the MWCC actually approves the change in SAC units based on the change in use of the property. <br />Mr. Dubats has inquired as to this change and feels that he as property owner is entitled to a <br />refund of the 3 units. The past practice of the City of Ramsey as well as the MWCC, has been to <br />reserve any credit balance SAC units to a specific site for future adjustments or take them for use <br />City-wide in the future. <br /> <br />This property is also located in the special district for utility charges. These charges are higher in <br />the special district so as to offset the cost of providing service because no special assessments <br />were incurred by the property owners at the time water and sewer was extended. The utility rates <br />that this property has been charged are at the minimum for the special district and are $165.00 for <br />water; $205.00 for sewer; $1.31 for water testing (mandated by State); and $10.73 for tax on the <br />water charge. This totals $382.04 and is the minimum bill for a property located in the special <br />disu'ict. Mr Dubats feels that since the use of this property has changed dramatically from the <br />prior use, that his utility bills should be reduced. <br /> <br />COMM1TrEE ACTION: <br /> <br />Recommend to the City Council that past practice be followed in the assignment of SAC credits <br />with the MWCC and apply them for use City-wide. <br /> <br />Take no formal action at this time.
