introduced the following resolution and moved for its adoption: Councitmember RESOLUTION #93.02- A RESOLUTION ADOPTING FINDINGS OF FACT # RELATING TO JEANINE DUFF'S REQUEST FOR A CONDITIONAL USE PERMIT FOR A PRIVATE DOG KENNEL. 1. That Jeanine Duff, hereinafter referred to as the "Applicant", has properly applied for a conditional use permit to maintain a private dog kennel for a maximum of ten (10) dogs. 2, That the Applicant appeared before the Planning and Zoning Commission on February 2, 1993 for a public hearing pursuant to Section 9.03.04 of the Ramsey City Code and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated by reference. 3. That the subject property is generally known as 16400 St. Francis Boulevard N.W. and is legally described as follows: Lot 1, Block 1, Duff and Towel Estates, Anoka County, Minnesota. 4. That the subject parcel is approximately five acres in size. 5. That the subject property is zoned R-1 Rural Residential. 6. That the surrounding parcels are also zoned R- 1 Rural Residential. 7. That Section 9.02 of the Ramsey City Code defines dog kennel as any place where three or more dogs over three months of age are kept. 8. That City Code regulations for the various zoning districts does not make provisions for dog kennels as permitted uses. 9. That Section 9.20.11 of the Ramsey City Code states that no buildings housing animals may be within 75 feet of neighboring property lines. I 0. That the proposed kennels are approximately 90 feet from the nearest property line. 11. That the Applicant has stated that no more than ten (10) dogs will be kept on the property. 12. That the Applicant has submitted building plans for an accessory structure and ten (10) kennel runs to accommodate the dogs. 13. That the Applicant has submitted a statement signed by six neighboring property owners stating their support for the request for the conditional use permit. 14. That there are other similar permitted conditional uses in the City. 15. That the proposed use will/will not be hazardous or disturbing to existing or future neighboring uses. '- 16. That the proposed use will/will not be an improvement to the property, the immediate vicinity and to the community as a whole.
