introduced the following resolution and moved for its adoption: <br /> <br />Councitmember <br /> <br />RESOLUTION #93.02- <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT # RELATING TO <br />JEANINE DUFF'S REQUEST FOR A CONDITIONAL USE PERMIT FOR A <br />PRIVATE DOG KENNEL. <br /> <br />1. That Jeanine Duff, hereinafter referred to as the "Applicant", has properly applied for a <br /> conditional use permit to maintain a private dog kennel for a maximum of ten (10) dogs. <br /> <br />2, That the Applicant appeared before the Planning and Zoning Commission on February 2, <br /> 1993 for a public hearing pursuant to Section 9.03.04 of the Ramsey City Code and that <br /> said public hearing was properly advertised and that the minutes of said public hearing <br /> are hereby incorporated by reference. <br /> <br />3. That the subject property is generally known as 16400 St. Francis Boulevard N.W. and <br /> is legally described as follows: <br /> <br /> Lot 1, Block 1, Duff and Towel Estates, Anoka County, Minnesota. <br /> <br />4. That the subject parcel is approximately five acres in size. <br /> <br />5. That the subject property is zoned R-1 Rural Residential. <br /> <br />6. That the surrounding parcels are also zoned R- 1 Rural Residential. <br /> <br />7. That Section 9.02 of the Ramsey City Code defines dog kennel as any place where three <br /> or more dogs over three months of age are kept. <br /> <br />8. That City Code regulations for the various zoning districts does not make provisions for <br /> dog kennels as permitted uses. <br /> <br />9. That Section 9.20.11 of the Ramsey City Code states that no buildings housing animals <br /> may be within 75 feet of neighboring property lines. <br /> <br />I 0. That the proposed kennels are approximately 90 feet from the nearest property line. <br /> <br />11. That the Applicant has stated that no more than ten (10) dogs will be kept on the property. <br /> <br />12. That the Applicant has submitted building plans for an accessory structure and ten (10) <br /> kennel runs to accommodate the dogs. <br /> <br />13. That the Applicant has submitted a statement signed by six neighboring property owners <br /> stating their support for the request for the conditional use permit. <br /> <br />14. That there are other similar permitted conditional uses in the City. <br /> <br />15. That the proposed use will/will not be hazardous or disturbing to existing or future <br /> neighboring uses. '- <br /> <br />16. That the proposed use will/will not be an improvement to the property, the immediate <br /> vicinity and to the community as a whole. <br /> <br /> <br />
