CASE # 5

REQUEST
CASE

FOR A CONDITIONAL USE PERMIT AMENDMENT;
OF DANNY'S ALUMINUM PROCESSING, INC.
By: Zoning Administrator Sylvia Frolik

Background:

As~vola may recall, in_...~eSeptember of 1992 you review,e_d an__0.J.~.c, ommenrled appro_v_al-of-a_~
~6~nditional dsc permit am~ite plan for Dann_y s Aluminum Processing, Inc. The site
ptarreOffgi~te~ of a new building to accommodate operations expansion and the
conditional use permit amendment was to allow for the disassembly of engines and transmissions
and acceptance of other non-hazarouds metals within the new building. That case was forwarded
to City Council where it was denied based on the concern that an expansion of the facility is not
appropriate when Mr. Karst seems to have difficulty complying with the terms of the conditional
use permit for the facility in its current size.

In December the City Council received complaints of continued non-compliance on the pan of Mr.
-Karsr~nd-C~ed ~u ini-dmc action neces'sary for Cu~ffcil tO consider re¥ocafion of~
the conditional urn-permit. In accorctance with C//y Code procerl-ffFC'5'T'fTff~ected the facility and
-senr-'Mr.~'~r~r 3 which described the violations and gave him 30 days to ~ ,'
correct the violations or a public heating would be scheduled to consider revocation. On January
6, 1993, I inspected the site as a finality to the the 30 day time frame. Mr. Karst was
compliance with his conditional use permit. This information was provided to City Council on
January 12 and they ceased proceedings to consider rovocation of Mr. Karst's permit.

At the January 12 Council meeting, Mr. Karst was present and explained that in order to be in
compliance with his conditional use permit, he had to shut down the engine and transmission
disassembly line and lay off the employees on that line. He requested that City Council reconsider
a conditional use permit amendment to allow for the disassembly of engines and transmissions
based on the fact that a similar facility in Ramsey is permitted to do so and in order that the
employees could be placed back on the payroll. Council directed City Staff to proceed to work
with Mr. Karst for a conditional use permit amendment as expeditiously as possible.

Observations:

On December 1, 1992, I inspected Danny's Aluminum Processing, Inc.

On December 3, 1992, I sent a written notice of the violations found on December 1 to Mr. Dan
Karst and gave him until January 5, 1993 to make the corrections. I also sought the assistance of
Minnesota Pollution Control Agency (MPCA) and Anoka County Environmental Services to
inspect the facility for compliance with those terms that I felt I was not qualified to address.

On December 11, 1992, Fereshteh Rahimzadeh of MPCA inspected Danny's Aluminum
Processing facility. Her verbal comments to me were that she observed the facility for a couple of
hours prior to approaching Mr. Karst for an on-site inspection and that she had no violations to
report.

On December 21, 1992, Duwayne Konewko of Anoka County Environmental Services inspected
Danny's Aluminum Processing, Inc. In summary, Mr. Konewko was impressed with the extent
to which Danny's Aluminum Processing is in compliance with State and County environmental
regulations. He also provided me with a copy of OSHA's inspection report dated October 28,
1992. The report indicates that there were some violations that were classified as non-serious that
have been corrected. The employees were also monitored for exposure to air and noise pollutants;
there were no violations.
