I I I I I i I I I I I I I I I I I by ordinance after a public hearing, affirmatively voted to vacate that certain area designated and dedicated as park in the plat of White Pine Estates, contingent upon the execution of this Development Agreement, and contingent upon the City Charter requirements as to the effective date of City Ordinances. A certified copy of the City's ordinance, vacating the subject property, when and if said ordinance becomes effective, shall be made available to the Developer for recording. The Developer shall cause to be obtained a quit claim deed from ~homas W. Anderson and Paula E. Anderson, husband and wife, the dedicators of said park and also the owners of 100% of the abutting property on said park, conveying all their right, title interest and equity in and to said park, in fee, to the City. In addition, pursuant to paragraph 3, Developer shall provide proof of escrow of the sum of $5100.00, representing a purchase price as noted in paragraph '3e below for the ultimate disposition of said park. c. Donation of~ Outlots Developer shall, upon execution of this Development Agreement, and contemporaneously with execution of the plat, execute quit claim deeds donating to the City, in fee, Outlot A, Outlot B, Outlot D, and Outlot E, Rum River Hills, subject only to the condition that said parcels be utilized for public recreational purposes consisting of a golf course and ancillary usages, whether in public or private ownership (see Exhibit C attached for form of restrictions tO be imposed by city). d. Reconveyance~bv City At such time as the city charter and ordinances of the City permit, the City shall, for the total sum of One dollar, convey to Rum River Hills, Inc., a Minnesota
