CASE <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT FOR AN ACCESSORY <br /> APARTMENT IN THE R-1 RURAL RESIDENTIAL DISTRICT; <br /> CASE OF CURTISS TITTERUD <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />Curtiss Tittered has applied for a conditional use permit to maintain an accessory apartment in the <br />lower level of his home at 6865 162nd Lane N.W. The Tittemd's are retired and live out-of-state <br />6 months a year. They rent the lower level of their home to provide year around security and <br />caretaking for their property. <br /> <br />The following items are enclosed for your review and information: <br /> <br />a) <br />b) <br />c) <br />d) <br />e) <br />f) <br /> <br />Site location map <br />Site plan <br />Petition from area residents <br />Copy of Zoning News dated April 1992 <br />Proposed findings of fact <br />Proposed conditional use permit <br /> <br />Observations: <br /> <br />The subject property and surrounding properties are zoned R-1 Rural Residential for which only <br />single family dwelling units are permitted. The Titterud's have provided the City with a petition <br />signed by area residents stating no objection to the request. <br /> <br />The apartment in the Titterud home is served by a separate driveway and access to the walk-out <br />level where the apartment is located. The Building Official has indicated that the on-site septic <br />system is minimal, but with the main level of the home only being occupied seasonally, the system <br />should continue to function properly. <br /> <br />For your information purposes, I have enclosed a copy of Zoning News dated April, 1992 on the <br />subject of accessory apartments as a means to providing affordable housing. <br /> <br />Recommendation: <br /> <br />It is Staffs recommendation that a conditional use permit be granted to Curtiss Titterud in lieu of <br />the seasonal occupancy of the main living part of the home. It is also staffs recommendation that <br />accessory apartments merit additional research and that the City should initiate action to establish <br />regulations for them. <br /> <br />Commission Action: <br /> <br />Motion to: <br />Recommend that City Council adopt findings of fact relating to Curtiss Tittemd's request <br />for a conditional use permit for an accessory apartment. <br /> \ <br /> <br />Motion to: <br />Recommend that City Council deny/approve Curfiss Tittemd's request for a conditional use <br />permit for an accessory apartment at 6865 162nd Lane N.W. <br /> <br />Review Checklist: <br />P&Z: <br /> <br />Zoning Administrator <br /> <br />9/'7/93 <br /> <br />'7 <br /> <br /> <br />
