CASE

REQUEST FOR SITE PLAN REVIEW OF TOP 10 CENTER;
CASE OF 7129 PARTNERSHIP
By: Zoning Administrator Sylvia Frolik

Background:

Ron Touchette of the 7129 Partnership is requesting site plan review to expand what will now be
called the Top 10 Center at 7129 Hwy. 4/10 N.W. The site is located immediately west of the
Holiday Stationstore and actually consists of two separate parcels, one measuring 1.8 acres in size
and the other measuring. 1 acre in size. The development on the site currently consists of a strip
service center which houses an off-sale liquor store, an auto repair shop and an auto body shop.
There also exists on the site a resident/al structure being rented as a duplex and a small used car
sales lot, the office for which is attached to the residential structure. There is also a small detached
garage behind the residential structure that is proposed to be demolished.

The applicant is proposing to expand the property under a phased program as follows:

Phase I -

I

'1
I
I
I
I
I
I
I
I

a)
b)

c)

768 square foot expansion to the auto repair suite
Construction of a 1,512 square foot accessory structure to the auto body shop to be
used as a delivery/est/mate center
Enclosure of secure area for cars awaiting repairs with a combination of chain link
and privacy fence
Demolition of detached gm-age behind residential structure

Phase II -

a) Construction of a 1,512 square foot expansioqi for the auto body shop

Phase III -

a)
b)

Construction of another 1,512 square foot suite
Demolition of the residential structure and car lot sales office. Tentative plans
would then be to replat the property to create a separate parcel sufficient in size for
development with a separate principal, permitted use from the strip center on the
other lot.

The following items are enclosed for your information:

a) Site location map
b) Excerpt from County half section indicating the 2 parcels that make up the site
c) Site plan
d) City Staff Review Letter dated September 30, 1993

Observations:

Although the site consists of two separate parcels, all 3 principal uses (strip center, duplex, used
car lot) exist on one parcel and this is not in conformance with City Code. Therefore, the duplex
and car lot are considered non-conforming and as such the uses may continue to exist. However,
to expand the uses would require a conditional use permit. If they are ever destroyed to an extent
exceeding 50% of their value, they may not be replaced without a conditional use permit. If the
