Councilmember introduced the following resolution and moved for its adoption: <br /> <br />PROPOSED RESOLUTION 893-10- <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE <br />PERMIT TO ESTABLISH A TOWING SERVICE AND AUTO REPAIR FACILITY <br />IN THE INDUSTRIAL DISTRICT <br /> <br />I <br />I <br />I <br /> <br /> WHEREAS, Champlin Towing, Inc. has properly applied for a conditional use permit to <br />establish a towing service with impound lot and an auto repair facility on the property generally <br />known as 15300 Sunfish Lake Btvd. N.W. and legally described as follows: <br /> <br />That part of the East 500 feet of the Northeast Quarter of the Southeast Quarter of Section <br />27, Township 32, Range 25, Anoka County, Minnesota lying north of the South 400 feet <br />thereof and lying south of the North 750 feet thereof (as measured along the south and east <br />lines thereof); except road; subject to easements of record; and <br /> <br /> WHEREAS, the Planning and Zoning Commission met on October 5, 1993, conducted <br />the public hearing and recommended City Council approval of the request. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />Based on Findings of Fact #. , a conditional use permit to establish a towing service <br />with impound lot and an auto repair facility is hereby granted to Champlin Towing, Inc., <br />hereinafter referred to as "Permit Holder", at 15300 Sunfish Lake Blvd. N.W. <br /> <br />That the perimeter of the impound lot shall be fenced and wherever chain link fence is used <br />a tree screening shall also be established to screen the outside storage from neighboring <br />uses, except that the east fence line of the impound lot shall consist of an eight (8) foot high <br />wood privacy fence and the planting of trees to intensify the affect of screening the use <br />from Sunfish Lake Blvd. N.W. <br /> <br />That the Permith Holder shall deposit a financial gdarantee with the City to ensure the <br />establishment of fencing and screening in accordance with the terms of this Permit. <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />That the Applicant shall accept all responsibility for maintaining the impound lot and auto <br />repair facility in accordance with Anoka County Environmental and Minnesota Pollution <br />Control Agency regulations. <br /> <br />That the towing service shall be permitted for 24 hour operation. <br /> <br />I <br />I <br /> <br />Adequate water supply and on-site sewage disposal facilities shall be the responsibility of <br />the Permit Holder. <br /> <br />Adequate off-street parking shall be prov/ded by the Permit Holder and ail impounded <br />vehicles or vehicles awaiting mechanical repairs shall be stored within the fenced and <br />screened impound lot. <br /> <br />I <br />! <br /> <br />With the exception of impounded vehicles and vehicles awaiting mechanical repairs on site, <br />there shall be no exterior storage of business equipment, mater/als, supplies, vehicle parts <br />or vehicles being dismantled for pans. <br /> <br />The City Administrator, or his designee, shall have the right to inspect the premises for <br />compliance and safety purposes annually or at any time, upon reasonable request. <br /> <br />I <br />I <br /> <br />10. <br /> <br />The Permit Holder shall be responsible for all City costs incurred in administering and <br />enforcing this conditional use permit. <br /> <br /> <br />
