I

1.

believe our options at this point are as follows:

Take no further action and wait until summer to see if
350 pigs on the site will in fact reduce the odor to a
tolerable condition.

Negotiate with Mr. Barthold further to reduce the number
and/or make improvements to the site such as concrete
which will help reduce the odor.

3. Commence nuisance prosecution and let the Court deal
now
/-.~~ with the issue. . . . .

The problem with options 1 and 2 above are timing. If we learn in
June or July that 350 pigs ar.e .too many because of citizen odor
complaints, it will be very dl. fflcult to get the Court to resolve
the issue in a short time durzng the summer season.

~I~would appreciate Council direction on Which option to take.

WMMI LAWSUIT

Last week I receive a proposed settlement agreement from WMMI's
counsel. The agreement does appear to contain those items we
discussed in our last settlement negotiation with WMMI. Some of
the exhibits for the agreement have yet to be presented by WMMI and
the actual payment numbers need to be inserted into the agreement.
I will review the agreement in detail with you at closed meeting
on January 26, 1993.
