The Permit Holder shall, at all times, have a sufficient supply of fire extinguishers located throughout the operation in conformance with the Uniform Fire Code. Fire Lanes. The Permit Holder shall properly construct and maintain all season paved fire lanes or properly pave and maintain drives and clearances to serve as fire lanes for the street side of the property to the back of the property. Contingency Action PLan. The owner or operator must prepare and maintain a contingency action plan for the aluminum processing facility. The plan must discuss what specific actions will be taken if a fn-e, spill or release occurs at the facility and that back-up system exists if portions of the facility are closed for any period of time. The plan must also identify a responsible contact person or persons for the facility who could be reached 24 hours a day in the event of a fire, spill, release or other serious problems along with their home addresses and phone numbers. TraiLer/Vehicle Storage. The use of trailers, trucks or vehicles for long term storage (longer than 30 consecutive days) is prohibited. All vehicles and trailers on site must bear a current license, be registered, and must be road worth3,. Structures and Site Improvements. The placement, design and construction of new structures or additions to existing structures and site improvements shall comply with City Code and applicable state codes and OSHA requirements. Sanitary Sewer. The Permit Holder agrees to connect to City sewer and water at the time sewer and water is extended to the area and herein agrees to join in a petition for such improvements when such petitions are presented. Height Limit on Equipment. The crane may be operated at it s full height but while being stored on the site shall not be stored at a height greater than the height of the smoke stack on the principal structures on the site. .- Closure Due to CUP Revocation, Other Circumstances. In the event this CUP is revoked or the Permit Holder closes operation of the aluminum processing operation for any reason, including but without limitation, order of the court or other agency of competent jurisdiction, bankruptcy, insolvency, or abandonment, the Permit Holder shall immediately proceed to remove all feedstock and other material from the site. tn the event the Permit Holder fails to comply with the terms of this CUP, the Cit'3, may, upon 30 days' written notice to the Permit Holder enter into the property and perform all such obligations, the costs of which shall be borne by the Permit Holder or, in default thereof, by its surety. 40. Financial Assurance. Danny's Aluminum Processing, Inc. shall submit financial assurances as follows: (a) Charges and Fees. Danny's Aluminum Processing, Inc. agrees to pay to the City upon the issuance of this CUP a fee in an amount sufficient to reimburse the City for engineering, legal and administrative expenses reasonably incurred during the consideration and development of this CUP. The Permit Holder shall reimburse the City for alt administrative fees incurred by the CiD, in connection with inspection of the aluminum processing operation and administration of this CUP.
