As required by the City Code Section 9.03.03, City Staff presented the proposed ordinance to the <br />Planning and Zoning Commission on January 5, 1993. The Planning and Zoning Commission <br />reviewed the proposed amendanent and directed staff to schedule a public hearing for February 2, <br />1993. <br /> <br />A public hearing was then conducted by the Planning and Zoning Commission on February 2, <br />1993. After receiving input from the residents in attendance, the Planning and Zoning <br />Commission recommended the following change to the proposed ordinance: <br /> <br />The exterior storage of two or more automobiles which do not have a current license plate <br />shall constitute a vehicle wrecking yard and shall not be permitted as an accessory use. The <br />showing for sale of not more than one automobile shall be considered an accessory use in <br />any zoning district not zoned for motor vehicle sales. Two or more vehicles shall constitute <br />an auto sales business and shall not be permitted as an accessory use. <br /> <br />The proposed ordinance by the Planning and Zoning Commission does not change the current <br />number of vehicles allowed. However, it does address the problem of automobile sales from <br />private residences, tt also corrects the current language problems of this section of the City Code. <br /> <br />The City Council would have the following options with regard to the proposed ordinance: <br /> <br />I) Not allow any unlicensed vehicles as originally proposed. This would allow for the easiest <br /> enforcement, but may result in some political backlash. <br /> <br />2) Adopt the ordinance as recommended by the Planning and Zoning Commission which <br /> would allow the City to control the number of vehicles sold on residential zoned properties. <br /> <br />3) <br /> <br />Change the proposed ordinance to allow one unlicensed vehicle outside of the MUSA and <br />Urban Reserve areas and not allow unlicensed vehicles inside the MUSA and Urban <br />Reserve areas of the City. This would allow for the continuation of the character of the <br />urban area with generally startler lot sizes. <br /> <br />Recommendations: <br /> <br />The Planning and Zoning Commission recommended adopting the ordinance amending Section <br />9. I1.02 Accessory Uses Subdivision 2 of the Ramsey City Code limiting the number of <br />unlicensed vehicles to one. <br /> <br />City Staff recommends that City Council adopt option #1 and restrict the number of unlicensed <br />vehicles to zero throughout the City. <br /> <br />Council Action: <br /> <br />Adopt proposed ordinance, option 1, 2, <br />Subdivision 2, of the Ramsey City Code. <br /> <br />Reviewed by: <br /> <br />or 3, amending <br /> <br />Section 9.11.02 Accessory Uses, <br /> <br />City Adminismator <br />Zoning Administrator <br />Project Manager <br /> <br />CC:02~3~3 <br /> <br /> <br />
