CASE <br /> <br /> REQUEST FOR A CONDITIONAL USE PERMIT FOR <br />A PRIVATE KENNEL; CASE OF JEANINE DUFF AND HOWARD TOWLE <br />By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />Jeanine Duff and Howard ToMe, 16400 St. Francis Boulevard N.W., have submitted an <br />application for a conditional use permit for a private kennel to maintain a maximum of ten dogs on <br />their property. The applicants are proposing to construct an accessory structure, a portion of <br />which will be devoted to the inside care needs of the dogs. Ten kennel runs will be attached to the <br />structure. Ms. Duff is in the business of breeding Yellow Labs. Enclosed for your information <br />are the following items: <br /> <br />A) <br />B) <br />C) <br />D) <br />E) <br />F) <br /> <br />Site location map <br />Certificate of Survey <br />Proposed building plans <br />Petition from neighboring residents <br />Proposed Findings of Fact <br />Proposed Conditional Use Permit <br /> <br />Observations: <br /> <br />The accessory structure, proposed by Jeanine Duff and Howard Towle, is within City Code <br />requirements with respect to size and materials for a five acre lot. <br /> <br />The proposed accessory structure will be more than 75 feet from property lines which is in <br />accordance with City Code regulations for structures that house animals. <br /> <br />The Planning and Zoning Commission conducted a public hearing and there was one person <br />present expressing opposition to the request. Subsequent to the meeting of the Planning and <br />Zoning Commission, the applicant met with the person opposing the request. Since their meeting, <br />the opposing person called me to withdraw his opposition to the request. <br /> <br />Recommendation: <br /> <br />The Planning and Zoning Commission and City Staff recommend approval of the request for a <br />conditional use permit. <br /> <br />Council Action: <br /> <br />Motion to: <br />Adopt Findings of Fact # relating to Jeanine Duff and Howard Towle's <br />request for a conditional use permit for a private dog kennel. <br /> <br />-and- <br /> <br />Motion to: <br />Approve/deny Jeanine Duff and Howard Towle's request for a conditional use permit for a <br />private kennel. <br /> <br />Reviewed by: <br />CC: <br /> <br />Zoning Administrator <br />Planning and Zoning Commission <br />3/2/93 <br /> <br /> <br />
