Councilmemb~r introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #93-03- <br /> <br />A RESOLUTION DECLARING CONDITIONS OF CONDITIONAL USE PERMIT <br />TO MAINTAIN A PRIVATE DOG KENNEL ON THE PROPERTY LOCATED AT <br />16400 ST. FRANCIS BOULEVARD N.W. (P.I.N. 14-32-25-12-0013) <br /> <br /> WHEREAS, the Ramsey City Council adopted Resolution #93-03- r e g a rd i n g <br />Findings of Fact # .. for this use and herein approves a conditional use permit subject to the <br />following conflition~: <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />On March 9, 1993, a Conditional Use Permit ("CUP") was issued by the City of Ramsey CCity") <br />to Jeanine Duff and Howard Towle ("Permit Holder") to maintain a maximum of ten (10) dogs on <br />the property generally known as 16400 St. Francis Boulevard N.W. and legally described as <br />follows: <br /> <br />Lot 1, Block 1, Duff and Towel Estates, Anoka Count>,, Minnesota. <br /> <br />This permit is issued pursuant to Section 9.03.04 of the Ramsey City Code. The conditions of this <br />permit are as follows: <br /> <br />1. This permit shall remain in effect so long as the conditions imposed herein are complied <br /> with, <br /> <br />A permanent structure with attached kennel runs shall be constructed on the site as shown <br />on the building plans submitted by the applicant and received by the City on January 12, <br />1993. <br /> <br />3. At no time shall there be more than ten (10) dogs over the age of three (3) months <br /> maintained on the premises. <br /> <br />If there are verified complaints of a noise or odor problem relating to the dogs, the permit <br />holder shall be so notified by City Staff and shall thereafter immediately abate the <br />nuisance. <br /> <br />5. No dog under the ownership of the Permit Holder shall be allowed to run at large on the <br /> subject proper'r>,, except under the direct supervision of the permit holder. <br /> <br />6. The kennel area shall be maintained in a sanitary condition according to State and local <br /> humane standards. <br /> <br />7. The permit holder shall not conduct a commercial boarding kennel or grooming business <br /> on the subject property. <br /> <br />8. The City Administrator or his designee shall have the right to inspect the premises for <br /> compliance purposes annually or at any time upon reasonable request. <br /> <br />9. The permit holder shall be responsible for City costs incurred in administering and <br /> enforcing this conditional use permit. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br /> and upon vote l:w~ing taken thereon, the following voted in favor thereof: <br /> <br /> <br />
