CASE <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT AMENDMENT; CASE OF <br />DANNY'S ALUMINUM PROCESSING, INC. <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />On February 23, 1993, the City Council adopted a positive findings of fact relating to Dan Karst's <br />request for a conditional use permit (CUP) amendment to allow the disassembly of engines and <br />transmissions at Danny's Aluminum Processing facility located at 14050 Basalt Street N.W. In <br />accordance with the recommendation of the Planning and Zoning Commission, the proposed <br />conditional usc permit presented for Council consideration had been amended to reflect as closely <br />as possible that which was issued to Alloy Recovery Company except in the following areas: <br /> <br />a) <br />b) <br /> <br />c) <br /> <br />d) <br /> <br />Permitted hours of operation would not change for Danny's Aluminum <br />Danny's Aluminum would retain the ability to prepare feedstock within a screened <br />area <br />The provisions for afterburners would be indicative of Mr. Karst's application <br />process with MPCA. <br />Site specific terms in Alloy Recovery's CUP pertaining to their new construction <br />would not be included in the CUP for Danny's Aluminum. <br /> <br />Consideration of the amended conditional use permit was tabled and Council requested that this <br />agenda include a copy of the conditional use permit issued to Alloy Recovery Company for <br />comparison purposes. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br /> <br />Current conditional use permit for Danny's Aluminum Processing <br />Findings of Fact #93-02-023 adopted on February 23, 1993 <br />Copy of conditional use permit issued to Alloy Recovery Company <br />Proposed conditional use permit for Danny's Aluminum Processing, Inc. <br /> <br />Observations: <br /> <br />As you recall, the City Attorney has stated that unless the applicant is a~eeable; the only term of <br />Mr. Karst's conditional use permit which probably should be addressed with this requested <br />amendment is Item #10, which prohibits disassembly of engines and transmissions. At the <br />meeting on February 23, the motion to approve a conditional use permit amending Item #10 only to <br />allow for the d./sassembly of engines and transmissions failed by a 3-2 vote. Mr. Karst's attorney <br />was present and stated that the applicant was willing to accept a conditional use permit amendment <br />that would allow for the disassembly of engines and transmissions and include various other <br />amendments that would make the conditional use permit more closely indicative of that which was <br />issued to Alloy Recover3,. <br /> <br />Recommendation: <br /> <br />City Staff and the Planning and Zoning Commission recommend approval of the conditional use <br />permit amendment.
