CASE # <br /> <br />REQUEST FOR FINAL PLAT APPROVAL OF AMBER RIDGE; <br />CASE OF GARY GORHAM AND TONY EMMERICH <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />Gary Gorham and Ton), Emmerich tire requesting final plat approval of Amber Ridge. The <br />proposed plat consists of approximately 61 acres located on the east side of T.H. #47, adjacent to <br />River's Bend. The property is proposed to be developed with approximately 123 single family <br />urban residential lots. <br /> <br />Tile following items are enclosed for 5'our information: <br /> <br />a) <br />b) <br />c) <br />d) <br />e) <br /> <br />Site location map <br />Proposed final plat <br />City Staff review letter dated April 21, 1993 <br />Resolution granting final plat approval <br />Proposed development agreement <br /> <br />Observations: <br /> <br />The subject property is currently zoned R-I Urban Residential, R-3 Urban Residential and B-2 <br />Business. The applicants have also submitted an application to rezone the entire property to R-1 <br />Urban Residential. If you approve the final plat, you are committing to approving the rezoning <br />which will be presented at your next meeting. <br /> <br />At the time of preliminary plat review, some of the lots were deficient of the minimum 10,800 <br />square foot of area; the developers have con'ected this deficiency. There are also some lots that <br />back up to non-protected wetlands that do not meet the City's policy of containing 10,800 square <br />feet of area above the wetland. At the t/me of preliminary plat approval, City Council waived the <br />10,800 square feet of area above the wetland policy because the wetlands are periodically dry and <br />have upland vegetation on them. <br /> <br />Acquisition of Outlot A in River's Bend is necessary for Lots '7 and 8 of Block 4 to meet minimum <br />area requirements and continuance of the trail corridor. The City gained ownership of Outlot A <br />through tax forfeiture and by State statute it is encumbered for drainage and utility purposes. The <br />City has initiated action to have the State lift the deed restrictions on the property. In order to deed <br />the outlot to the developers, the City must adopt an ordinance and the ordinance would not take <br />affect for 30 days following adoption. The developers desire to record the plat by the first week in <br />May and without benefit of the ordinance allowing the City to deed the property to the developers <br />immediately, it will be necessary for the City to sign off on the plat as an interested part3,. The <br />developers have a~eed to reimburse the City $1,500.00 in cash for administrative costs incurred in <br />having the deed restrictions lifted and conveying the outlot to them. The balance of compensation <br />due the City for the outlot, and any outstanding park dedication balance due, would be provided by <br />the developer constructing a continuance of the trail from the north boundary of their plat through <br />Juniper Woods to 153rd Avenue. The City would be responsible for the site grading and <br />restoration of such construction through Juniper Woods. <br /> <br />All of the lots in the plat would have access from interior streets; there will be no lots with direct <br />access onto T.H. #47. In accordance with the conditions gamed at the time of preliminary plat <br />approval, Argon Street N.W. south of 147th has been platted as an 850 foot dead end. Therefore, <br />the development agreement does provide a variance to the 600 foot maximum dead-end street <br />length. As part of that, the undeveloped area in this southern portion of the plat would be reserved <br />for future development when an additional access onto T.H. #47 in this area is feasible. <br /> <br /> <br />
