However, the construction costs is estimated to be One Hundred One Thousand Seven <br />Hundred Fifteen Dollars and no/cents ($101,715.00). The DEVELOPER shall receive <br />credit based upon reasonable unit prices, subject to the ,'tpproval of the City Engineer, <br />associated with the actual constructions costs for the trunk sewer improvement plus Fifteen <br />Thousand Six Hundred Fifty Dollars and no/cents ($15,650.00) to cover the plan <br />preparation, inspection, permit fees, and final "as-built" pi;ms associated with this trunk <br />sewer extension. <br /> <br />In addition, tile DEVELOPER will receive credit for the difference in construction costs <br />between a twelve (12) inch watermain and related appurtenances and an eight (8) inch <br />watermain and related appurtenances. Tile estimated amount of this credit is Eighteen <br />Thousand Dollars and no/cents ($18,000.00), however, the actual amount shall be <br />determined by actual quantities applied to the following unit price differences between eight <br />(g) and twelve (12) inch watem'mins: <br /> <br />Item <br /> <br />Watermain <br /> <br />Gate valve with box <br />Ductile and gray iron footings <br /> <br />Unit Price <br />$3.55 per foot <br /> <br />$270.00 each <br /> <br />$0.95 per lb. <br /> <br />Upon completion of the construction, the actual costs of the project will be calculated and <br />the amount due determined. The estimated sewer and water trunk charges due from the <br />DEVELOPER, following above outlined credit, are estimated to be Seventy Thousand <br />Four Hundred Eight Dollars and no/cents ($70,480.00). The DEVELOPER and CITY <br />agree to have this amount specially assesed equally among the 123 residential lots. The <br />DEVELOPER hereby agrees to waive all rights to a public hearing for said assessment as <br />well as the right to contest the amount of the assessment. If it is determined by the City <br />Attorney that such a special assessment cannot be made based upon legal requirements, <br />then the DEVELOPER agrees to pay the entire amount owed in full within thirty (30) <br />days of written request by the CITY. <br /> <br />In the event the final trunk costs result in the DEVELOPER having a negative amount <br />owed to the CITY, the CITY will remit the amount owed to the DEVELOPER within <br />thirty (30) days of the final costs being certified by the City Council, except that in no event <br />shall the amount exceed Twenty Five Thousand Dollars and no/cents ($25,000.00). <br /> <br /> <br />
